Annex.................................................................................................................................................... 85 4 Summary Harbin-Jiamusi Railway passes by two cities and three counties, with the total length of 343km, including the 336.8km new lines, 179.435km mainline subgrade, 154.064km mainline bridges and 9.845km mainline tunnels, with the bridge-tunnel ratio of 47.74%. There are 15 stations along the line, including 13 new intermediate stations. Harbin-Jiamusi Railway Project was commenced on July 10, 2014, with the period of 2014 to 2018, or totally 4.5 years. Harbin-Jiamusi Railway Project has a total budget of RMB 38.6 billion, which was jointly funded and constructed by China Railway Corporation and local government. The new Harbin-Jiamusi Railway Project (Jingyang Street to Nanzhi Road Section) utilizes the existing lines for renovation, and the mainline is 5km long, which is a double-track electrified railway. The whole line has totally 2 stations, Binjiang and Taipingqiao. It passes by the 7 subdistricts, 10 communities and 2 stations (Binjiang Station and Taipingqiao Station) of Daowai District, Harbin. The World Bank-loaned Harbin - Jiamusi Railway Project (hereinafter referred to as "the Project") uses the loan of the World Bank as part of the construction and investment. Due to the adjustment of the scheme for Jingyang Street – Nanzhi Road Section Works and affected by the line deviation, a certain number of urban houses have to be additionally demolished and relocated in these regions (5 sub-districts and 7 communities) in the works. The scope of works and resettlement covered by this section is not included in the original Resettlement Action Plan for Harbin-Jiamusi Railway. Therefore, according to the World Bank Safeguard Policy, OP/BP4.12 (Involuntary Resettlement). A report for adjusting the resettlement action plan of this section should be compiled as the important and necessary supplement to the resettlement action plan of the project. The Harbin-Jiamusi Railway (Jingyang Street to Nanzhi Road Section) will be built based on state-owned land completely, and no collective land will be acquired. Affected by the project, about 67349.44 square meters of urban residential houses will be relocated and 816 households or 2173 people will be affected. Fifteen residence-for-business houses 1will be relocated, covering an aggregate area of 939.4 square meters. Nine enterprises or 21240 square meters will be relocated. The relocation will affect 5 sub districts and 7 communities. In addition to housing relocation, the project will also involve the relocation of attachments to various buildings, relevant equipment and infrastructure, as well as the relocation of buildings reserved due to noise and vibration impacts. The resettlement investigation team carried out a comprehensive social and economic survey for the 7 communities under the jurisdiction of the 5 affected sub districts in Daowai District, Harbin. The survey includes: 1) the investigation of socioeconomic status of the affected sub districts and communities; 2) family economic situation of the project affected persons (PAPs); 3) the investigation of wishes and intentions of the PAPs. The survey was performed by various means including door-to-door questionnaire and workshop of relevant insiders. In this survey, 250 urban relocation households were sampled, accounting for 30% of the total PAPs. The samples cover various people groups which are affected by the project relocation, and are typical and representative. Among the surveyed 652 people from 250 households, 11% of them are under 18 years old, 62% are 18-59 years old, and 27% are above 60 years old. Except the minors under 18 years old, among the 551 adult respondents, 23% of them have the primary school or below education ground, 38% have the junior middle school education, 20% have received the high education, and 18% have the junior college and above education background. In terms of labor employment, employed people account for 72% of the total PAPs. Most of them (231 1 Residence-for-business houses refers to a type of house, some room of which is transformed for business purposes..Residence-for-business houses affected by the project are separately accounted for in order to distinguish from the pure residential houses of urban citizens. 5 people) are employed by enterprises, accounting for 42%, 78 are employees of public institutions, accounting for 14%. The number of public servants, soldiers and enterprise managers is 22, 26 and 40 respectively, representing 4%, 5% and 7%. About 154 people are employed workers who are not accounted for, accounting for 28%. In terms of the resident income, the sources of income are mostly dependent on their fixed salary and business income. Wage is the absolutely main source of the family income. 95% of families have the per capita net income higher than RMB 10,000 annually; and only 5% of the families have the per capita net yearly income less than RMB 10,000. Most of these families earn the per capita of RMB 10,000 – RMB 30,000/year. According to the statistics about the family expenditure, in the average consumption mode of the affected people, food purchase, education and culture, health care consumption accounted for a large proportion, about 65%. The per capita disposable income is about RMB 27610. With regard to the housing conditions and house ownership, the residents of Songguo, Shengzhong and Liangku Communities have very poor housing conditions, as the houses were mostly built in 1980s and less maintained. Most of the bungalows are not provided with tap water, sewers and other infrastructure. Brick-concrete and brick-wood structures account for 74%. Because of poor living conditions, more than 90% of the residents have already moved to other places long time ago and more than 95% of house title owners have the second house. And for the PAPs in Xingye and Nankan Communities, because the houses are high-rise buildings which were built in recent years, the living amenities in these communities and surroundings are well equipped. Therefore, the buildings are owned and built by these PAPs, and most of these PAPs have only house, only 8% have two houses. The land acquisition and relocation of these areas will not only allow the residents to have considerable monetary resettlement or the framework structure houses larger than their original houses, but also will greatly improve the health, environment, public security and transportation of these areas. Therefore, general public is eager to be relocated. The project is greatly supported by the PAPs. The housing relocation compensation standard for urban residents is subject to Housing Acquisition and Compensation Scheme for the New Harbin-Jiamusi Railway (Jingyang Street to Nanzhi Road Section). The housing demolition and relocation for the project is carried out by three means, monetary resettlement, property swap resettlement and independent purchase of commercial housing. The specific resettlement modes and compensation standard are shown in the right matrix of the project. The overall objective of this project is to provide resettlement houses adaptive to local habitat conditions and human-oriented resettlement policy, to ensure that the living standards of PAPs will restore to a level not worse than the level before the project. The housing compensation and resettlement measures involved in this project will not be limited to monetary resettlement, property swap replacement is also acceptable, to ensure that the living standards of the resettled persons will be restored and improved. The relocation will be done in a principle of “resettlement first, then demolition�. This resettlement has been implemented on many other projects in the same area of Harbin, which is deemed as compliant with the actual resettlement situation and acceptable to the people: In the housing resettlement: 94% of the PAPs chose property swap (including the purchase of commercial housing) and 6% of them chose monetary resettlement. Through the analysis of the people choosing different resettlement modes, the investigation team had a good understanding and demonstrated the capability of the affected people of regaining a house. The survey findings showed that the affected people of the project can obtain the house relocation compensation at RMB 6500-9938/square meters. Through visits to the communities and the investigation on the surrounding housing market prices, it is found that the market price of ordinary commercial houses on the same region is RMB 6200-7500/square meter. This scheme will be completely able to help the PAPs regain new 6 houses, no matter which resettlement mode they choose. Among the demolished households, 286 people of 105 households are tenants. The households of relocated tenants account for 13% of the total relocated houses. When these tenants terminate the deed with the title owner, they will consult with the title owner to get back the paid rental and deposit, and will also get some temporary transitional expenses and movement bonus. If the affected people fail to reach an agreement with their tenants on the termination of the deed, the housing acquisition authority of the district shall swap the property right for the affected people, instead of monetary resettlement. The houses in the property right swap will be rented by the original tenant, and the affected people should resign a new house lease contract with the original tenant. Resettlement of non-residential houses: among the 7 residence-for-business stores which are still in operation, 3 of them are operated and managed by the title owners while 4 are managed by tenants. 2 households chose property swap and exchange the stores for residential houses, and 1 household chose monetary resettlement and will not run a business. 4 tenants will get some monetary resettlement after consulting with the property owner to terminate the lease contract, and will seek new spaces to continue their business. For 3 unoccupied stores and 5 garages, the property owner chose the monetary resettlement. Housing tenants and property owner should negotiate with each other. If the lease agreement concluded between the affected person and tenant has already set out the provisions on the acquisition and the corresponding solutions, such agreement should govern. If no provisions are made, the property owner should return the rental and deposit to the tenant, and compensate the tenant for the resulting decoration, relocation, business and other losses. The amount of compensation shall be determined by both parties in accordance with the agreement. Enterprise placement: among the 9 enterprises to be relocated, 5 are out of business and chose monetary resettlement. They will not continue the operation any longer. Among the other 4 enterprises, one enterprise is partially demolished, and its normal operation will not be affected after monetary resettlement. The remaining 3 enterprises are wholly demolished enterprises, which will seek new establishments for continual operation after obtaining monetary resettlement. The total resettlement budget for the project is RMB 1,048,080,400, including RMB 887.78 million for urban relocation (85%) and RMB 160.3 million (15%) for other management expenses. The resettlement investment funds of this project are all from the local government, and the government of Harbin City participates in the railway construction with the land acquisition and resettlement expenses. In the collected funds, about 46% of the funds are used for the land acquisition and relocation of Harbin-Jiamusi Railway (Jingyang Street to Nanzhi Road Section), and the remaining 53% of the funds will be used as the land acquisition and relocation expenses for Harbin-Mudanjiang Railway (renovation works at Harbin Station). The land acquisition and relocation work is organized by the People’s Government of Daowai District of Harbin City, and Relocation Office of Daowai District of Harbin City will be responsible for the implementation, with the relocation expenses listed into the total budget of the project. The land acquisition and relocation funds are mostly raised by the government of Harbin City, and the remaining funds are loans from major banks. At the initial stage of the project, the publicity and information disclosure will be carried out to ensure the popularization of the project. The construction purpose and significance of the project, construction time and location of the project, as well as the special provisions on implementing the national land acquisition and relocation policies formulated by the provincial and district levels should be widely publicized through a wide range of media, such as radio, television, newspapers and magazines. In addition, a relatively perfect and transparent representation system has been established for the project, which ensures the expression of opinions by the PAPs in the process of project implementation. 7 The owner of the project is Harbin-Jiamusi Passenger Dedicated Line Co., Ltd., the resettlement relocation implementation organization is Housing Acquisition Office of Daowai District of Harbin City, and the overall coordination organization is Leading Group Office for Major Project Construction Promotion for Harbin Railway. Although Harbin-Jiamusi Passenger Dedicated Line Co., Ltd., Urban House Relocation Management Office of Daowai District of Harbin City and Leading Group Office for Major Project Construction Promotion for Harbin Railway govern the construction, acquisition and demolition of both Harbin-Jiamusi Railway and Harbin-Mudanjiang Railway, Harbin-Jiamusi Railway is different from Harbin-Mudanjiang Railway in terms of management requirements and procedure as the former is a foreign-funded project. Therefore, these organizations shall separately appoint directors to constitute the Land Acquisition and Relocation Department, who shall be responsible for the land acquisition and relocation management of Harbin-Jiamusi Railway. The department comprises the directors of all affected communities, who shall cooperate with and support the railway construction and resettlement. The resettlement action plan (RAPs) for the project has been compiled by Sichuan Fontal Strategic Consulting Co., Ltd. commissioned by Harbin-Jiamusi Passenger Dedicated Line Co., Ltd., and was submitted to World Bank for appraisal in September 2016. According to the requests of World Bank, since the start of land acquisition, demolition and resettlement, the external monitoring and assessment agency must submit the independent external monitoring and assessment report to the World Bank via the Owner on a regular basis, and should carry out one or two monitoring and assessment investigations and submit the resettlement monitoring and assessment reports according to the resettlement progress. The section mentioned in this report is a new section of the newly built Harbin-Jiamusi Railway after the design adjustment. The external monitoring organization for resettlement shall truly reflect the resettlement activities, demolition progress and resettlement conditions of this section in the external monitoring report. 8 1. General 1.1 Project Overview 1.1.1 Overall Profile of Project Harbin - Jiamusi Railway is located in the central and eastern parts of Heilongjiang Province. It is located across Harbin City and Jiamusi City on the southern bank of Songhua River. The line starts from Harbin, passing through Binxian County, Fangzheng County and Yilan County until it reaches Jiamusi Station in Jiamusi City. It passes by two cities and three counties, i.e. Daowai District, Acheng District, Xiangfang District, Binxian County, Fangzheng County and Yilan County of Harbin City and Xiangyang District, Qianjin District, Dongfengqu and suburban areas of Jiamusi City. There are totally 15 stations along the line, including 13 new intermediate stations: Binxi North, Binxi East, Binzhou, Shengli, Shuanglonghu, Fangzheng, Demoli, Gaoleng, Dalianhe, Yilan, Hongkeli, Xinghua and Pingan Power Station; and the other 2 stations are joint stations, Harbin Station and Jiamusi Station. Harbin - Jiamusi Railway Project was commenced on July 10, 2014, with a construction period of 2014 to 2018, or totally 4.5 years. Harbin-Jiamusi Railway Project has a total budget of RMB 38.6 billion, which was jointly funded and constructed by China Railway Corporation and local government. The local government is responsible for land acquisition and relocation work and expenses within their jurisdiction. The land acquisition and relocation expenses will be raised by the municipal and provincial governments, which, after the confirmation by all related parties, will be charged to the equity as the local capital. The other capital will be assumed by China Railway Corporation from the railway construction fund and own funds of railway enterprises. Harbin-Jiamusi Railway passes by 2 prefecture-level cities and 3 subordinate counties and 7 subordinate districts, with the permanently acquired land of 23393.6 mu, and the aggregate demolished area for the buildings along the main line is 382442m2. (Source: Resettlement Action Plan for the New Harbin-Jiamusi Railway prepared by China Railway Third Survey & Design Institute Group Co., Ltd. (December 2012)) Harbin-Jiamusi Railway is an important construction project listed in Mid-and Long-term Railway Network Planning (Adjusted in 2008) and Railway Development Planning for the 12th Five-Year Plan, which is the critical channel for the passenger and freight transportation between the northeastern Heilongjiang and other cities in the province as well as between the provinces in China’s northeastern parts and local regions. Harbin-Jiamusi Railway, upon the completion, will enhance the northeastern China's road network, optimize the express passenger transportation network layout in the region, alleviate the contradiction between the volume and capacity of Harbin-Jiamusi Corridor, and will play an important role in securing the smoothness of the rear section of China-Russia Port Railway, accelerating the development of port station, promoting the complement and win-win results between China and Russia in economic field, boosting the coordinated socioeconomic development of Heilongjiang Province and making sure the smooth implementation of the strategy “revitalizing the old industrial base of Northeastern China�. 1.1.2 Overview of Project Adjustment The scheme of the Harbin-Jiamusi Railway (Jingyang Street to Nanzhi Road Section) at the original feasible study stage: the existing stations will be introduced on both 9 ends of Harbin-Jiamusi Railway, and the railway alignment is along the existing railway, and the impact of Harbin-Jiamusi Railway trains on the existing lines and station renovation will be reduced. Harbin-Jiamusi Railway will be jointed at Taipingqiao Station, and Binjiang Line is utilized to introduce to Harbin Station (Jingyang Street to Nanzhi Road Section), and double-track railway utilizes the existing Binjiang Three-line an Binjiang left and right lines for renovation, not exceeding the original track of the existing line. Due to the adjustment of the railway construction planning, the Harbin-Mudanjiang Dedicated Passenger Railway Project was introduced. The scheme for connecting Binjiang Line from Taipingqiao Station (Jingyang Street to Nanzhi Road Section) was adjusted, and the construction scheme is changed as below: Jingyang Street - Binjiang Station Section maintains the design of 4 lines (the left and right lines of Harbin-Jiamusi Railway and left and right lines of Harbin-Mudanjiang Dedicated Passenger Line), Harbin-Jiamusi Railway moves northward, and the existing Binba Line and Binjiang Line Three are utilized for renovation. Most of the sections are basically consistent with the location of the existing railway track, and some sections are moved northward by 1-2m in respect to the existing Binba Line. Binjiang Station Section, Harbin-Jiamusi Railway and Harbin-Mudanjiang Dedicated Passenger Railway are introduced for the renovation of Harbin Station via this station, there will be no station for the Harbin-Jiamusi Railway Mainline, Harbin-Mudanjiang Mainline and renovated yard. Passenger trains will pass by this station without making a stop. This stop is a dead-end station on Binjiang Line Three. For Binjiang Station – Taipingqiao Station (Section), after the introduction of Harbin-Mudanjiang Dedicated Passenger Line, 5 lines will be designed (renovated Binjiang Line Three, left and right lines of Harbin-Jiamusi Railway and left and right lines of Harbin-Mudanjiang Dedicated Passenger Line), and some sections are almost identical to the position of the existing line track. Some sections shall deviate towards the northwest by 1-18m from the existing railway track according to the railway engineering technical requirements. The Diagram of renovated Binjiang Station please see the appendix figure 1-1. Taipingqiao Station – Nanzhi Road (station yard), Harbin-Jiamusi Railway and Harbin-Mudanjiang Dedicated Passenger Line pass by the station, and the existing Majiagou Bridge will be demolished. After the renovation, 4 mainlines, 3 arriving-departing lines and 2 safety lines will be built at the station. The existing signal building and other production houses to be demolished will be restored on the left of the site. The Diagram of Renovated Taipingqiao Station please see the appendix figure 1-2. 1.2 Supplemental Descriptions of Resettlement Action Plan The works within the original feasibility study scheme for Harbin-Jiamusi Railway (Jingyang Street to Nanzhi Road Section) will use the existing lines, and the lines will not move and no land acquisition or relocation will be involved. Therefore, Resettlement Action Plan for the New Harbin-Jiamusi Railway (December 2012 version) does not impact on the PAPs and resettlement plan within the above section. After the change of the project design, some urban houses will inevitably have to be demolished and relocated within the region (5 subdistricts and 7 communities) under the project because of the line movement. According to the requirements of the World Bank's safeguard policy, it is necessary to make investigations of the supplemental resettlement investigation on the adjusted section on the line, and a resettlement action plan will be compiled, in order to ensure the affected persons on the line will be 10 appropriately placed. 1.3 Preparation of Resettlement Action Plan In August 2016, Harbin-Jiamusi Passenger Dedicated Line Co., Ltd. commissioned Sichuan Fontal Strategic Consulting Co., Ltd. to compile the resettlement action plan for the land acquisition and relocation of the project. In mid and late August 2016, the resettlement investigation team of Sichuan Fontal Strategic Consulting Co., Ltd. investigated the relevant subdistrict and communities related to the project, conducted the social and economic investigation, negotiated with related department and affected population on the compensation policy and resettlement program, and prepared the resettlement action plan for the project. 11 2. Social and Economic Investigation In order to have a good command of the basic conditions of the PAPs and analyze the impact of the project construction on local resettled people, the resettlement investigation team carried out a comprehensive social and economic survey for the 7 communities under the jurisdiction of the 5 affected subdistricts in Daowai District, Harbin. A census of all affected people and an inventory of losses were carried out. The survey includes: 1) the investigation of socioeconomic status of the affected subdistricts and communities; 2) family economic situation of the project affected persons (PAPs); 3) the investigation of wishes and intentions of the PAPs. The survey was performed by various means including door-to-door questionnaire and workshop of relevant insiders. The new Harbin-Jiamusi Railway (Jingyang Street to Nanzhi Road Section) Project involves the demolition of urban residential houses in 5 subdistricts and 5 communities. Affected by the project, about 67349.44 square meters of urban residential houses will be relocated, and 816 households, or 2173 people will be affected.. In this survey, 250 urban relocation households were sampled, accounting for 30% of the total PAPs. The samples cover various people groups which are affected by the project relocation, and are typical and representative. The district governs 22 subdistricts and 4 towns. It borders Xingfu Township and Chenggao Town to the south in Xiangfang District, adjacent to Xiangyang Township of Xiangfang District and Acheng District to the east, and at the opposite side of Hulan District with a river in between. The urban area has 22 12 subdistricts, including Daxing, Dayou, Sanke, Huagong, Taigu, Taiping, Renli, Shuini, Huochetou, Dongyuan, Donglai, Minqiang, Nanma, Nanzhi, Shengli, Zhenjiang, Chongjian, Binjiang, Xinyi, Xinle, Jingyu, Lihua, and there are 4 towns of Tuanjie, Yongyuan, Juyuan and Minzhu, involving 38 administrative villages. The district has 114 community residents' committees and 38 village committees. The total area of Daowai District is 615.26 square kilometers, of which the urban areas are 40.62 square kilometers, the urban areas are 577.98 square kilometers and arable land is 8434 hectares. The total population is 808.6 thousand, comprising 20 ethnic groups including Han, Manchu, Hui, Korean, Mongolian, Ewenki, Oroqen, Hezhe, Tibetan, Uygur, Xibe and Russian. The total population of Daowai District is 1015850 people, from 397045 households. Among them, the permanent resident population is 674629 people, and there are 342 007 permanent households; there are 165116 floating people, and 176105 living in a place different from their registered residence. Among the permanent population, the urban population is 551558 people, or 283713 households, rural population is 123071 people, or 58294 households; and the there are 331011 males and 343618 females. The annual birth rate is 4.24‰, the mortality rate was 5.24‰, so the natural population growth rate of -1.01‰, which is in line with the fertility rate of 98.15%. During the 12th Five-Year-Plan period(2010-2015), the district’s GDP was expected to be increased from RMB 28.78 billion to RMB 43.62 billion, with the annual growth of 9.6%. The public budget revenue was expected to be increased to RMB 2.57 billion under the mew fiscal management mechanism in 2015, increased by 18% over 2010 based on the comparable gauge. The investment in fixed assets was expected to increase from RMB 15.72 billion to RMB 27.53 billion, with the average annual increase of 11.9%; and the total retail sales of social consumer goods were expected to be increased from RMB 24.91 billion to RMB 48.36 billion, with an average annual increase of 14.2%. The structure of three industries is further adjusted to 2.1:31.9:66.0, and the tertiary industry dominated by modern service sector has become a pillar for the economic development of the district. The GDP comprehensive energy consumption per ten thousand yuan was decreased by 16%. Urban residents' per capita disposable income reached RMB 30308, increased by 7.2%, and the per capita disposable income of permanent rural residents was RMB 14472, with an increase of 12%. By the end of the year, the total retail sales of social consumer goods of the district were 48.49208 billion, with an increase of 12.3%. Among them, the wholesale and retail sales of social consumer goods of wholesale and retail trade recorded RMB 44.22579 billion, increased by 12.3%; and accommodation catering industry recorded RMB 4.26629 billion, with an increase of 12.3%. 2.1.2 Social and Economic Conditions of Affected Subdistricts According to the field survey, the new Harbin-Jiamusi Railway (Jingyang Street to Nanzhi Road Section) pass five subdistricts, i.e. Sanke Subdistrict, Taiping Subdistrict, Lihua Subdistrict, Chongjian Subdistrict and Nanma Subdistrict. Through the field investigations at these subdistricts and reference to the Harbin Statistical Yearbook of 2015, the basic social and economic conditions of these subdistricts are summarized2 as follows: Sanke Subdistrict: Sanke Subdistrict covers a total area of 2.8 square kilometers, and it governs 6 communities, 12169 households and 31637 people. There are 17 streets of various sizes, including 5 Class A and Class B streets. Data source: Overview of Subdistricts and Harbin Statistical Yearbook of 2015 13 quarters and 2 college, primary and middle schools under the jurisdiction. There are a lot of inflow population, where they live scattered and for a short period of time. There are a few large and medium-sized enterprises, and there are a lot of shantytowns or bungalows. A lot of people are unemployed, and many residents are small-sized peddlers. The floating population is relatively centralized. There are 2053 floating persons in the subdistrict, in the first half of 2016; RMB 195 million worth of foreign investment was introduced. Taiping Subdistrict: Taiping Subdistrict has 5 communities and 8 properties. The area is located in the central and northern part of Daowai District, starting at Majiagouhe to the west to Xinjiangqiao Street to the east, Yandi Street to the north and Dongzhi Road to the south, with a total area of 0.96 square kilometers. There are 11341 households and 37970 people residing at the subdistrict. There are 341 households of low-income security, living under the poverty line and low income, and 176 of which are disabled low-income security. There are 63 senior aged people at their 80s, 54 at their 90s and 1 at the 100s in the subdistrict. There are 133 non-public enterprises and 413 individual businesses in the jurisdiction. In the first half of 2016, RMB 430 million worth of investment was introduced, and additional RMB 250 million is expected to be introduced in the second half. The objective for the investment in fixed assets is RMB 620 million, and the subdistrict will strive to accomplish such target by the end of the year. In 2014, Taiping Subdistrict will introduce Harbin-Jiamusi Passenger Dedicated Line Co., Ltd. This company has a total investment of RMB 5.4 billion and registered capital of RMB 100 million, and has become a pillar enterprise for attracting investment and business in the subdistrict. Lihua Subdistrict: it is located in the northeast part of Daowai District, Harbin, Heilongjiang Province. It is an old urban area. It starts at Taipingqiao, adjacent to Taiping Street and Xinle Street, and ends at Xindao Street Railway Overpass and adjoins Zhenjiang Street. It borders Nangang District to the south and is in vicinity of Songhua River. It covers an area of 4.4 square kilometers, and the population is 31563 people from 11683 households, governing 5 communities. The subdistrict is located at Pinzi Building in Lihua Quarter. The main trunk roads include Dongzhi Road, Nantong Street, etc. In 2016, the Subdistrict has introduced investment of RMB 150 million. Chongjian Subdistrict: Chongjian Subdistrict is located at the central part of Daowai Urban Area, with an area of 0.41 square kilometers. It governs 10361 households and 21912 people. The floating population is 975 people, and 484 households, or 659 people enjoy the low-income security. There are 839 disabled people. There are 10 streets, 68 residential buildings (402 units), one shantytown (5500 square meters, 1132 households and 2770 people) in the jurisdiction. In the first half of 2016, RMB 230 million worth of investment was attracted. Nanma Subdistrict: it covers an area of 1.35 square kilometers, with the population of 56858 people and 21345 households. There are 6 communities and 585 residential groups in the jurisdiction. There are 307 houses and 445 people enjoying the low-income security, 22 households are under the poverty line, 3 are low-income households, and 874 are disabled people. There are 34 streets in the jurisdiction, and 26 bus lines. They are the transit hub in Harbin. There is the provincially largest food market, Nanji Commodity Trading Center in this jurisdiction. In addition, there are 7 large and medium shopping malls such as markets of food machinery, cable, stationery distribution, KC fur and Black Swan Home Appliance. 14 2.1.3 Social and Economic Status of the Affected Communities The affected communities of the project include Shengzhong Community of Sanke Subdistrict, Lvhua Community, Songguo Community and Jianping Community of Taiping Subdistrict, Liangku Community of Lihua Subdistrict, Xingye Community of Chongjian Subdistrict, Nankan Community of Nanma Subdistrict. The basic social and economic profile of these communities is shown in Table 2-2. This investigation mainly focused on family population, age structure, education, labor and employment, annual household income, annual household spending, family resources and other information of the affected families. In this sampling survey, 250 affected households and 652 people were investigated, accounting for 30% of the affected people, or 2.6 persons per family, including 312 women, accounting for 47.8% of the surveyed population. 1. Age composition and gender analysis In a survey of 652 people in 250 households, the age distribution is as follows: 72 persons (11%) are under 18 years old, 403 persons (62%) are 18-59 years old, and 177 persons (27%) are above 60 years old. See Table 2-3 for details. Education Except the minors under 18 years old, among the 551 adult respondents, 127 persons (23%) of them have the primary school or below education ground, 212 persons (38%) have the junior middle school education, 110 persons (20%) have received the high school and above education, and 102 persons (18%) have the junior college and above education background. Employment and occupation In the surveyed 551 people, employed people account for 72% of the total PAPs. Most of them (231 people) are employed by enterprises, accounting for 42%, 78 are employees of public institutions, accounting for 14%. The number of public servants, soldiers and enterprise managers is 22, 26 and 40 respectively, representing 4%, 5% and 7%. About 154 people are employed workers who are not accounted for, accounting for 28%. Housing Conditions and Housing Ownership The investigation teams surveyed the housing conditions of the residents from 5 communities affected by the demolition, and found that Songguo Community, Shengzhong Community, Liangku Communities have very poor housing conditions, as the houses were mostly many years ago. There are 91 households living in bungalows, accounting for 80%. The houses of the affected in Xingye Community and Nankan Community are frame-structure buildings, which are solid and reliable. Refer to Figures. 2-1 through 2-4 for the appearance structure of the demolished houses. Less than 20% of the residents live in the existing houses, and other houses are vacant houses. And for the PAPs in Xingye and Nankan Communities, because the houses are high-rise buildings which were built in recent years, the living amenities in these communities and surroundings are well equipped. Therefore, the buildings are owned and built by these PAPs, and most of these PAPs have only house, only 8% have two houses. Family Resources In the survey of household durable goods, materials and resources, the popularity rate of the general public home appliances has been basically reached 100%. Family Income and Expenditure According to the surveyed findings about resident income, the sources of income are mostly dependent on their fixed salary and business income. Wage is the absolutely main source of the family income. 95% of families have the per capita net income higher than RMB 10,000 annually; and only 5% of the families have the per capita net yearly income less than RMB 10,000. Most of these families earn the per capita of RMB 10,000 – RMB 30,000/year. According to the statistics about the family expenditure, in the average consumption mode of the affected people, food purchase, education and culture, health care consumption accounted for a large proportion, about 65%. The per capita disposable income is about RMB 27610. In addition to that, the savings of different families are different, and 10% of the income is deposited into bank on average. Refer to Table 2-9 for the survey statistics of the income and expenditure of urban residents. The households of relocated tenants account for 13% of the total relocated houses. In Songguo Community, Liangku Community and Shengzhong Community where the house structures are old and shabby, Less than 20% of the residents live in the existing houses, and other houses are vacant houses. Among the 74 residential households, most of them are from other places and rent local houses. In the three communities, there are 57 tenant households, accounting for 77%. Refer to Table 2-10 for the statistics of tenants. The investigation team interviewed nearly 10 tenants. Of them, 5 tenants living in bungalows, and most of them are migrant workers working on construction site, vegetable wholesale market or fur wholesale market of Harbin from other provinces. Because the houses in this area are old, the rental is low, about RMB 500-800/month, depending the area and provision of home appliances and furniture. The respondents said that their residency is near their workplace. If their workplace changes, their domicile will also be relocated accordingly. They have nearly 2 months to move and seek transitional measures as the houses are to be demolished. Because railway demolition occurs within 30m within the environmental line and this area is populated section, it is easy for them to find other houses for living in the same quarter 30 meters away the railway. In addition, the tenants in Binjiang Xincheng and Nankan Residential pay RMB 1200-2000 per month as rental. Most of the tenants are local workers, who cannot afford a new house temporarily. They can continue to rent a house in the same quarter. In order to better understand women's social work, family status and social status in the project areas, the investigation team visited the local Women's Federation of the project areas, and paid particular attention to women in the sampling survey of affected families. In all the sampled 250 households and 652 people, 312 are women, accounting for 47.8% of the surveyed population. The settlement investigation team learnt from the questionnaire survey that women in the project areas are almost the same to their male counterparts in terms of education, employment and family and social status. As shown in Table 2-4, men and women in the project areas have similar 20 education background, but the proportion of women receiving the education higher than junior middle school level is less than men. In terms of women's employment and productive work, Table 2-5 showed that the employment structure of men and women in the project areas is similar. In the division of labor by gender, according to the door-to-door economic survey and the interviews of some women, in the project affected areas, the major family work mode is that both of the husband and wife work outside and earn a living. With regard to the participation in public affairs, the results of interview with some women showed that the proportion of women in the project areas is very high, and most of the respondent women are active to express their opinions about and vote for the public affairs. 2.5 Survey of Impacts of the Project on Minorities In the areas affected by the project, the investigation team paid particular attention to the distribution and living conditions of the ethnic minorities in these areas. According to the demographic survey of the population and its distribution, the affected 5 subdistricts and the 7 communities under their jurisdiction are inhabited by a number of ethnic minorities. These ethnic groups include the Hui, Uygur, Manchu, Korean, Mongolian, etc. According to the survey, these ethnic minorities account for only 2% of the total population of the community on average (see Table 2-10), and no minority settlement exists. In terms of the minority groups which are adversely affected by the relocation and construction of the project, they do not "collectively attach to the residence or the ancestral territory with unique geographical features, or depend on these residential areas and territory natural resources", do not have "the traditional cultural, economic, social or political system different from the mainstream of society", and they are even not "unique or weak social and cultural groups". In the door-to-door survey, it is found that the use Mandarin in the daily work and life, and their living habits are almost identical to Han people. They are able to freely and equitably communicate with others in the implementation of public participation. Project Impact 3.1 Scope of Project Impact The World Bank-Loaned Harbin-Jiamusi Railway Project is 343.344km long, which is a double-track electrified railway. There are 15 stations along the line. Harbin - Jiamusi Railway is located in the central and eastern parts of Heilongjiang Province. It is located across Harbin City and Jiamusi City on the southern bank of Songhua River. The line starts from Harbin, passing through Binxian County, Fangzheng County and Yilan County until it reaches Jiamusi Station in Jiamusi City. It passes by 2 cities, 3 counties and 7 districts. The land acquisition and relocation impacts of Harbin - Jiamusi Railway Project include the permanent land acquisition of various lands for the main line works, impacts on various kinds of buildings and attachments, relevant equipment and infrastructure, as well as the relocation of buildings reserved due to noise and vibration impacts. In the original design scheme, Harbin-Jiamusi Railway (Jingyang Street to Nanzhi Road Section) utilizes the existing lines, and only Sanke Subdistrict of Daowai District involves the urban relocation. However, due to the adjustment of the railway construction planning, the Harbin-Mudanjiang Dedicated Passenger Railway Project was introduced. The scheme for connecting Binjiang Line from Taipingqiao Station (Jingyang Street to Nanzhi Road Section) was adjusted. Affected by the line deviation, a certain number of urban houses have to be additionally demolished and relocated in these regions (5 subdistricts and 7 communities) in the works. The scope of works and resettlement covered by this section is not included in the original Resettlement Action Plan for Harbin-Jiamusi Railway. The new Harbin-Jiamusi Railway Project (Jingyang Street to Nanzhi Road Section) has a main line of 5km, which is a double-track electrified railway. The whole line has totally 2 stations, Binjiang and Taipingqiao. It passes by the 7 subdistricts and 10 communities of Daowai District, Harbin. This railway will be built based on state-owned land completely, and no collective land will be acquired. Affected by the project, about 67349.44 square meters of urban residential houses will be relocated, and 816 households, or 2173 people will be affected. Fifteen residence-for-business houses3 will be relocated, covering an aggregate area of 939.4 square meters. Nine enterprises or 21240 square meters will be relocated. The relocation will affect 5 sub districts and 7 communities. In addition to housing relocation, the project will also involve the relocation of attachments to various buildings, relevant equipment and infrastructure, as well as the relocation of buildings reserved due to noise and vibration impacts. Affected by the project, about 67349.44 square meters of urban residential houses will be relocated, and 816 households, or 2173 people will be affected4. Refer to Table 3-1 for the impacts of urban demolition and relocation of the new Harbin-Jiamusi Railway (Jingyang Street to Nanzhi Road Section). Among them, fifteen residence-for-business houses will be relocated, covering an aggregate area of 939.4 square meters. Nine enterprises, or 21240 square meters will be relocated. Among these enterprises, 5 are out of business, and in the remaining 4 enterprises, 1 enterprise is partially demolished and its normal operations will not be affected. The other three ongoing enterprises will have to be completely demolished, with the aggregate demolition area of 1300 square meters and about 30 people will be affected. See Table 3-3 for the details of enterprise demolition conditions. The major infrastructure affected by the project should be restored by the construction company, and all expenses should be included into the engineering costs, rather than the budget of the resettlement expenses. Of them, 816 households and 2173 persons are affected by the urban housing demolition5; 15 households and 27 persons are relocated residence-for-business houses6, and 15 are relocated enterprises, with 431 affected persons. See Table 3-5 for the details of PAPs. The investigation team investigated the number of households enjoying low-income guarantees, disabled households, and extremely poor household and woman-dominated families. There are 131 people of the vulnerable groups affected by the project. Refer to Table 3-6 for the quantity of affected vulnerable groups. Resettlement Policy Framework 4.1 Background – Necessity of the Supplemental Resettlement Action Plan (SRAP) Since the approval of the original Harbin-Jiamusi Railway Resettlement Action Plan (RAP) in December 2012, alignment of the 5-km Harbin Station Section (Nanzhi Road – Harbin Station) has changed in order to accommodate the proposed Hamu Railway that will share some of the right-of-way of this section. The alignment change adds a section from Jingyang Street to Nanzhi Road in Daowai District, Harbin City to the project alignment. This addition and the fact that no land acquisition and resettlement activities have yet taken place necessitates the preparation of a supplemental RAP. In addition, to facilitate smooth building demolition and resettlement of project affected people currently reside in this section, Harbin People’s Government of Daowai District has formulated specific compensation and resettlement policies for this section based on several consultations in the field and the actual data of Harbin City house relocation and resettlement activities in 2016. These policies will be incorporated in the SRAP. 4.2 Resettlement Objectives of Project The resettlement policy objectives for the affected persons in Harbin – Jiamusi (Jingyang Street to Nanzhi Road Section) include: 1. The engineering, technical and economic measures shall be taken to avoid or reduce the physical quantity of land acquisition, relocation and resettlement; when the land acquisition and relocation is unavoidable, effective measures shall be taken to reduce the impacts of land acquisition and relocation on the production and living of local residents; 2. In the project preparation stage, the social and economic investigation shall be carried out and corresponding resettlement action plan shall be compiled. 3. The resettlement, based on the demolition physical indexes and compensation standard, is aimed to improve or at least restore the production and living standards to the original level; 4. Advocate the human-oriented resettlement. The urban relocation and resettlement will be carried out by multiple means (resettlement before the demolition), through many optional alternatives, or the nearby property swap resettlement, to minimize the impacts on the affected people; 5. Establish and improve the basic living security system for the relocated vulnerable groups; 6. Encourage the resettled persons to participate in the resettlement plan; and establish an open, transparent and effective grievance & complaints mechanism. 4.3 Eligibility for entitlements In accordance with relevant laws and the World Bank ’s safeguard policy OP4.12 requirements, the new Harbin-Jiamusi Railway (from Jingyang Street to Nanzhi Road) Project will involve the following groups, who are eligible for resettlement and compensation pursuant to this Resettlement Action Plan: 1) Urban residents affected by the demolition; 2) Demolished house tenants (including residence, residential/commercial house, and enterprise tenants); 3) Enterprises; 27 4) Public infrastructure property owners; and 5) Vulnerable groups 4.4 Policies and Laws Applicable to the Project 4.4.1 Legal framework In view of land acquisition, housing demolition, resettlement and compensation, China has developed a complete legal framework and policy system. Within the framework of national laws and policies, all local governments at various levels have enacted and implemented the relevant laws and policies, in order to manage and guide the land acquisition, housing demolition and relocation, resettlement and compensation. Heilongjiang Province and Harbin City, in accordance with national laws and policies, have formulated relevant local laws and policies, in order to manage and guide the relevant work related to the land acquisition and relocation of the project. The demolition and relocation personnel of the project shall strictly abide by the relevant provisions and implementation measures at the province, city and district levels, World Bank safeguard policy , the design documents of the project, etc. The main legal and policy references are: a) Regulation on the Expropriation of Buildings on State-owned Land and Compensation (Order of the State Council No. 590 of the People’s Republic of China, effective from January 2011) b) Measures on Housing Acquisition and Appraisal on State-owned Land (JF [2011] No. 77) c) Regulations on Housing Demolition and Relocation Management of Heilongjiang Province (effective from March 1, 2002) d) Circular on Printing and Releasing Relevant Regulations (Trial) of Housing Acquisition and Compensation on State-owned Land of Harbin City of Housing Acquisition Office of Harbin Municipal People's Government (HFZF No. [2011] No. 2) e) Circular on Printing and Releasing Supplementary Regulations of Housing Acquisition and Compensation on State-owned Land of Harbin City of Housing Acquisition Office of Harbin Municipal People's Government (HFZF No. [2012] No. 6) f) Housing Acquisition and Compensation Measures on State-owned Land of Harbin City (Order No. 7 of Harbin Municipal People's Government, effective from February 10, 2014) g) Work Process of Harbin City on Housing Acquisition and Compensation on State-owned Land of Harbin City h) Housing Acquisition and Compensation Scheme for New Harbin-Jiamusi Railway (Jingyang Street to Nanzhi Road Section)(2016,September) i) World Bank Safeguard Policy, OP/BP4.12 Involuntary Resettlement 4.4.2 Chinese Laws, Regulations and Policies at National, Provincial and Municipal Measures on Housing Acquisition and Appraisal on State-owned Land (JF [2011] No. 77) specifies: Article 2 The Measures shall apply to the appraisal of the acquired houses on the state-owned land and the value of houses for property swap, measurement of the 28 market price of the property similar to the acquired houses, as well as the double check appraisal and verification of the relevant appraisal results. Article 5 The appraisal of the housing acquisition for the same expropriation project, which shall be undertaken by a property valuation appraisal organization. If the housing acquisition involves a larger area, two or more property valuation appraisal organizations may be entrusted with the appraisal. In this case, these organizations shall negotiate to determine one of them as the leader, which shall organize all appraisers to discuss the appraised objects, appraise time, value content, appraisal basis, appraisal assumptions, appraisal principles, appraisal technical route, appraisal methods, selection of important parameters and determination of appraisal results to normalize the standards. Article 6 After the selection or determination of the property appraisal organization, the party which acquires houses shall, as the client, issues a power of attorney for housing acquisition appraisal to the property appraisal organization and both parties shall sign a housing acquisition appraisal contract. Such power of attorney shall specify the name of the client, name of the entrusted property appraisal organization, appraisal purpose of assessment, appraisal object and scope, appraisal requirements, as well as the date of entrustment. Article 8 The purpose of appraising the value acquired houses shall be stated as "to provide a basis for the acquiring party and the affected person to determine the compensation for the acquired houses and appraise the value of the acquired houses". The purpose of appraising the houses for property swap shall be stated as "to provide a basis for the acquiring party and the affected person to calculate the difference between the value of acquired house and the value of property swap house and appraise the value of the houses for property swap." Article 9 Prior to the appraisal of acquired acquisition, the acquiring party shall organize relevant companies to investigate the acquired house to clarify the appraised object. The appraised object shall be comprehensive and objective, without omission or falsification. The acquiring party shall provide the entrusted property appraisal organization with the basic conditions of the houses to be acquired, including the identification and treatment of the registered houses and unregistered buildings. The investigation results shall be disclosed to the affected persons to the extent of housing acquisition. The registered houses, the nature, purpose and building area shall be based on the records in the housing title certificate and housing register; in case of any inconsistency between the housing title certificate and housing register, the latter shall prevail, unless it is evidenced as having mistake by clear proof. For the unregistered buildings, they shall be appraised in accordance with the identification and treatment results of the people’s governments at the municipal and county levels. Article 16 The property appraisal organization shall provide the preliminary appraisal results by residential unit in accordance with the power of attorney of housing acquisition or entrustment contract. The preliminary appraisal results by residential unit shall include the constitution of the appraised object as well as basic conditions and appraised value. The acquiring party shall publicize the preliminary appraisal results (by residential house) to the affected people to the extent of acquisition. During the publicity, the property appraisal organization shall arrange the certified property appraiser to explain the preliminary appraisal results based on residential units. If there is an error, the property appraisal organization shall correct it at once. Housing Acquisition and Compensation Measures on State-owned Land of Harbin City (Order No. 7 of Harbin Municipal People's Government) specifies: 29 Article 2 The Measures shall be applicable to the state-owned land acquisition and its compensation (hereinafter referred to as housing land acquisition and compensation) for the sake of public interest. Article 8 If houses have to be acquired for the project construction, the party which organizes the construction or the people’s government of the district shall organize the study. If the provisions of Article 7 herein are satisfied, an application report for including into the annual housing acquisition plan shall be submitted to the municipal housing acquisition authority. The application report of housing acquisition plan shall include the following contents: (I) Basic descriptions of the project; (II) Proof of compliance with the public interest and the relevant planning and plan; (III) Estimates and implementation of the required acquisition compensation funds; (IV) Implementation of property swap mode; (V) Intention of compensation and resettlement of enterprises and public institutions; (VI) Arrangement of project implementation plan; (VII) Other relevant materials required by municipal housing acquisition authority. Article 12 After the release of the housing acquisition notice, the district housing acquisition authority shall register the ownership, location, structure, purpose, building area, family members, housing security qualifications, housing use and other affairs of the houses within the acquisition scope. If the house is not for residential use, the affiliation, production and operation, facilities and equipment, on-the-job employees, economic benefits, acquisition resettlement intent, etc. shall be investigated and registered. Article 14 The district housing acquisition department shall be responsible for the development of housing acquisition compensation scheme and submitting it to the People's Government of the District. The housing acquisition compensation scheme shall include the following contents: (I) Purpose and legal basis of the compensation for housing acquisition; (II) Scope of housing acquisition; (III) Compensation, standard and calculation method of housing acquisition; (IV) Reward and subsidy standards; (V) Basic situation of housing for property swap; (VI) Signing period of compensation for housing acquisition; (VII) Transition mode and transition period for relocation; (VIII) Compensation and resettlement modes of enterprises and public institutions; (IX) Other relevant matters. Article 15 District People's Government shall organize the competent authorities of housing acquisition, development and reform, urban and rural planning, land resources and finance to carry out the demonstration of the housing acquisition compensation scheme, and disclose such results to the extent of acquisition in order to solicit the public opinions,. The time limit for comments shall not be shorter than thirty days. If houses are to be acquired in the renovation of old urban areas and more than half of the affected people believe the compensation scheme is incompliant with 30 the laws, regulations and the Measures, the District People's Government shall organize the affected people and public representatives to attend a hearing. The District People's Government shall timely publicize the received opinions and the accepted ones to the public. Article 16 Prior to making a decision, the District People's Government shall organize to clarify the houses for property swap according to the wishes of the affected people, carry out the social stability risk assessment, and develop and implement social stability risk preventive, alleviative and solving measures. The District People's Government shall, in accordance with the acquisition compensation, make sure adequate compensation expenses are available, and deposit them to the bank account designated by the municipal housing acquisition authority. Article 17 The District People's Government, after making a decision for housing acquisition as required, shall make an announcement through news media to the extent of housing acquisition. The announcement shall set out the acquisition compensation programs, administrative reconsideration, administrative litigation rights and other matters. Article 21 The compensation standard for the acquired houses must not be lower than the market price of the property similar to the acquired houses on the date of announcement of the housing acquisition decision. Unless otherwise specified by the government for the price of the houses for property swap, the prices of the acquired houses and houses for property swap shall be determined by the qualified property appraisal organization (hereinafter referred to as “appraisal organization�) based on relevant regulations. Circular on Printing and Releasing Relevant Regulations (Trial) of Housing Acquisition and Compensation on State-owned Land of Harbin City of Housing Acquisition Office of Harbin Municipal People's Government (HFZF No. [2011] No. 2) specifies that: Article 1 Provisions on the area of property swap for relocated residential house: in case of the property swap for relocated residential house, if the residential land for the property swap resettlement is inferior to the residential land within the acquisition scope by two or below levels, each house with valid title license is entitled to an extra building area of 10 square meters free of charge; if the residential land for the property swap resettlement is inferior to the residential land by more than two levels, each house with valid title license is entitled to an extra building area of 20 square meters free of charge. If the residential land for the property swap resettlement is superior to the residential land or at the same level, no extra building area will be added. Residential land level shall be determined by the residential land level defined by the municipal land and resources authority. Article 2: Provisions for the property swap of residential house greater than 70 square meters in floor area: if the acquired building area greater than 70 square meters are subject to the property swap, the standard immediately above the original housing building area shall be adopted, and the standard house type shall be ascended by adding each 10 square meters. After the immediately higher standard type is adopted for acquired residential house greater than 70 square meters, the difference between the building area of standard house type and building area of original house shall be used for the settlement. Any excess of the original house building area shall be subject to the payment of the purchase based on comprehensive construction costs. Article 3: Provision on the swapping the residential housing property for high-rise residential housing: if the multi-storey (and below) residential houses are swapped for 31 a high-rise house, the building area of standard type immediately above the acquired residential house shall be divided by 1.45 to calculate the useable area, based on which the high-rise residential house shall be designed and constructed. The difference between the actually measured building area of the designed and constructed high-rise residential house and the building area of immediately higher standard house shall be exempted from the housing payment. Article 4: Provisions on the difference between the actually measured building area of the property swap house and the agreed building area: If the actually measured building area of the property swap house is greater than the agreed building area, the affected person shall pay the acquisition costs based on the construction and installation costs in case of security type house, or pay the housing purchase costs based on the comprehensive construction costs in case of standard house type. If the actually measured building area of the property swap house is smaller than the agreed area, the inadequate part shall be returned to the affected person based on the calculated commercial housing price. Article 5: Provisions on the value of property swap houses: If the housing property swap policy is executed in the housing acquisition, the value of the property swap house must not be lower than the aggregate amount of the acquired house value and housing payment paid by the affected person for the building area difference. Article 6: Provisions on balcony area of residential houses: If the building area indicated in the title certificate of the acquired residential housing does not include the building area of the originally designed balcony, the actually measured measure of the closed balcony shall be charged to the building area of the acquired house. 50% of the actually measured area of open balcony shall be included into the building area of acquired house. The balcony built by the occupants shall be demolished by the occupants themselves without any compensation. 4.4.3 World Bank Policy on Involuntary Resettlement Overall objectives of World Bank policy on involuntary resettlement OP4.12 and procedure BP4.12 include: � To avoid and minimize involuntary resettlement wherever feasible, and seek all feasible alternative programs for project design. � Where the involuntary resettlement is unavoidable, the resettlement activities should be regarded as the sustainable development plan for consideration and implementation. The objective is also to provide sufficient investment resources to enable the persons displaced by the project to share in project benefits. � To carry out meaningful consultations with the displaced residents, who shall have the access to the planning and decision-making in relation to the resettlement action plan. � The current policy objective is to assist displaced people “in their efforts to improve their livelihoods and standards of living or at least to restore them, in real terms, to pre-displacement levels or to levels prevailing prior to the beginning of project implementation, whichever is higher. 4.5 Resettlement Policy for the Project 4.5.1 Urban Resident Housing Demolition Policy According to the Housing Acquisition and Compensation Scheme for the New Harbin-Jiamusi Railway (Jingyang Street to Nanzhi Road Section), People's Government of Daowai District who decides to acquire houses shall compensate the 32 affected people. The affected people can choose either monetary resettlement or property swap. If the affected person chooses property swap, he/she can exchange the property within the areas designated by the government, or purchase commodity residential house from the platform offered by the government. The specific resettlement policies are as follows: I. Monetary resettlement and policy: The amount of monetary compensation shall be determined by the appointed appraisal company in line with the housing acquisition appraisal measure based on the location, purpose, building area and depreciation of the acquired house. The compensation standard for the acquired houses must not be lower than the market price7 of the property similar to the acquired houses on the date of announcement of the housing acquisition decision. Unless otherwise specified by the government for the price of the houses for property swap, the prices of the acquired houses and houses for property swap shall be determined by the qualified appraisal organization based on relevant regulations. The evaluation agency is chosen by 1) open tendering or 2) negotiating with the expropriated persons or their representatives within the specified period; should the negotiation fail, the District Housing Expropriation Authority will organize the expropriated persons to vote, following the principle of minority obeying the majority. Or alternatively, they will select the evaluation agency by lot drawing, the process and result of which will be then notarized by Notary Office. Open tendering shall follow the process: 1) Daowai District Demolition Office issues the public notice on tendering, inviting qualified agencies to take part in the public bidding; 2) a professional tendering company is responsible to select the successful bidder among qualified evaluation agencies, and makes the successful bidder public for a period of 15 days; 3) during this period, the relocated persons may, in case of any objection to the successful bidder (evaluation agency), put forward their proposals and comments, followed by rectifications as per related regulations and procedures; in case of any problems identified, invitation for bid will be conducted again. Otherwise, the official commission will be authorized after the publicity period, followed by housing evaluation. The monetary resettlement shall follow the principle of “resettlement/compensation first and then relocation, achieving the replacement of the relocated persons�. The monetary compensation should meet the standard of replacement cost, which includes the market price and other miscellaneous fees (transaction fees, taxes, other administrative expenses etc.), By way of monetary comparison, the affected persons are completely can purchase the commercial housing with same area in same district within scope of compensation fees. The compensation will be paid in due time as required, and any loss of interests arising from delay in payment will be borne by the Project Office, with such fees included in the relocation costs. II. Property swap resettlement policy within the areas designated by the government: 1) According to the building area indicated in the valid title certificate of the 7 Market price are only the evaluation prices of houses, excluding any other miscellaneous fees (transaction fees, taxes, other administrative expenses etc.) arising from housing transaction or replacement. 33 acquired residential house, the resettlement shall be carried out in a way that one square meter acquired shall be compensated by one square meter, and the immediately higher standard house type shall be adopted. 2) This project will provide a number of replacement houses for the affected households selection,. This resettlement site has been constructed completely. � Resettlement /relocation site : in-progress high-rise commodity houses of Taoci Community (crossing between Daxin Street and Hongqi Avenue). The standard residential units include the types of 40 square meters, 50 square meters, 60 square meters, 70 square meters, 80 square meters and 90 square meters. The resettlement site will be finished by the end of 2016; � Resettlement /relocation sites: high-rise commodity houses of Wutongjun (Shuiyuan Road). The standard residential units include the types of 50 square meters, 60 square meters, 70 square meters and 80 square meters. This site construction will be finished by the end of 2016; � Resettlement /relocation site: high-rise commodity houses of Dongsheng Jiangjun (Daxin Street). The standard residential units include the types of 50 square meters, 60 square meters, 70 square meters, 80 square meters, 90 square meters and 100 square meters. This resettlement site has been constructed completely; The above houses shall be chosen by residents in accordance with the sequential number on the acceptance register. 3) The part of the property swap house equal to the original building area, no differential price will be settled. The difference between the immediately higher house type and original building area shall be subject to the payment of housing costs by the affected people based on the comprehensive construction costs. The comprehensive construction cost of the high-rise residential building is RMB 3120 per square meter, and the building and installation costs shall be RMB 1940 per square meter of building area. 4) If the affected people requires the property swap where the substitute property is smaller than the original building area, the monetary compensation shall be carried out for the difference between the original building area and building area of the substitute house based on the appraisal value. 5) If the residential housing is swapped for a high-rise residential housing, the building area of standard type immediately above the acquired residential house shall be divided by 1.45 to calculate the useable area, based on which the high-rise residential house shall be designed and constructed. The difference between the actually measured building area of the designed and constructed high-rise residential house and the building area of immediately higher standard house shall be exempted from the housing payment. 34 6) If the actually measured building area of the property swap house is greater than the agreed building area, the affected person shall pay the acquisition costs based on the construction and installation costs in case of security type house, or pay the housing purchase costs based on the comprehensive construction costs in case of standard house type. If the actually measured building area of the property swap house is smaller than the agreed area, the inadequate part shall be returned to the affected person based on the calculated commercial housing price. 7) The affected persons choosing property swap houses shall be exempted from the floor differential price. 8) If the building area indicated in the title certificate of the acquired residential housing does not include the building area of the originally designed balcony, the actually measured measure of the closed balcony shall be charged to the building area of the acquired house. 50% of the actually measured area of open balcony shall be included into the building area of acquired house. The balcony built by the occupants shall be demolished by the occupants themselves without any compensation. Resettlement housings shall be allotted in the following process: 1) by public participation, understanding the relocated persons’ opinions on resettlement; 2) based upon their resettlement intentions, conducting the investigation for identifying property-swapped housing source, and submit the detailed construction planning for the requisitioned land and construction design schemes or certifications of property swap to Harbin Expropriation Office for the record; 3) making public the resettlement program and housing source information; 4) organizing the house choosing, and paying the house price differences as required; 5) canceling the original housing property rights, and making property registration of the resettlement housings; 6) paying the housing demolition compensations to the affected persons; 7) delivering the keys to the relocated persons. III. Resettlement policy for purchasing the commodity housing: 1) If the affected people choose to purchase commodity housing for resettlement, the acquisition party of Daowai District shall sign the Agreement on Compensation and Resettlement for Housing Acquisition with the affected people. The momentary settlement for buying a new house by the affected person shall be calculated in accordance with the market price of the ordinary commercial residential house of the same type on the same section in the project area after deduction of the housing purchase costs of the immediately higher standard house type. The market value of the commodity residential houses in the acquisition area shall be determined by more than five appraisal organizations invited by acquisition authority of the district, and the house building area shall be determined by the immediately higher standard house type agreed in the acquisition agreement. The obtained funds for purchasing a house must not be directly converted to the monetary resettlement costs; 2) The affected persons shall get the subsidies for purchasing the house, and each house will be entitled to the subsidy of housing purchase equal to RMB 50,000. 3) The housing administration bureau of the city shall provide the availability information about commodity residential houses for the purchase by the 35 affected people. The information about the housing announced on the platform shall govern. IV. Security resettlement policy for residential housing: 1) If the per capita building area of the affected families is lower than Harbin’s standard in the previous year, the total building area is less than 40 square meters (including 40 square meters), and the affected person is unable to pay in full the payment for the immediately higher standard house type of 50 square meters, they can choose the property swap for the 40m2 minimum level indemnificatory house. If the minimum level indemnificatory house is greater than the original building area, the affected person can pay the housing purchase costs in accordance with the construction and installation costs; or rent a house temporarily at the lowest rental. After the affected person becomes financially better, he/she can make in full the housing purchase co40m2 minimum level indemnificatory house est. 2) The residents holding the Minimum Living Security Certificate for Urban Residents shall be given additional RMB 20,000; and the disabled persons holding Certificate of Disabled Persons of the People’s Republic of China will have RMB 10,000 additionally. V. Non-residential (including residence-for-business) housing resettlement policy: Non-residential houses can be resettled by three methods: They are: money resettlement, property swap within the areas designated by the government and purchase of commodity house. In the event of the non-residential leased houses under the direct management of the government, if the business entity managing the property which is authorized by the government cannot terminate the lease deed with the tenant, the property swap shall be conducted, and the original lease will be continuously maintained. The public non-residential house of the acquiring party shall be subject to the prior negotiation between the owner and tenants. If the lease deed is terminated after negotiation, the owner shall be compensated according to the relevant laws and regulations; otherwise, the housing property swap will be conducted, and the original lease will be continuously maintained. If the owner transfer the ownership of the house to the tenant, the owner shall be entitled to compensation after both parties complete the transfer procedure and the original tenant obtains the housing ownership. 1) If the monetary resettlement is selected, the value of the acquired houses shall be appraised and determined by a qualified property appraisal organization, and the compensation shall be equal to the due monetary resettlement plus 30%. 2) If the housing property swap is selected, the property swap shall be carried out by the residential housing property swap plus 10 square meters. The additional area shall be subject to the payment of purchase costs based on the comprehensive construction costs, or subject to the residential housing property swap with the difference of appraised value settled. 3) If the purchase of commodity houses is selected, the monetary funds for purchasing a new to be obtained by the affected person in the monetary settlement shall be equal to the due monetary resettlement plus 30%, after deduction of the housing purchase costs for the immediately higher standard house type in accordance with the market price of the similar commercial house at the same location. The affected persons shall purchase the 36 commercial house and settle the difference of appraised value. VI. Property swap resettlement policy within the areas designated by the government: 1) In the prescribed signing term, if the gained area of the applicable standard house type is less than 10 square meters, the 10 square meters will be subject to the construction cost, and the part thereafter till the applicable house type area shall be purchased by the discounted price of commercial house. 2) If the affected person chooses the residential house of the high-rise resettlement community of the in-progress Taoci Community, they are allowed to purchase 20 square meters at a discounted price (RMB 5300 per square meter) based on the original normal applicable house type area. If they want to make further purchase, the price will be RMB 6300. 3) If the affected person chooses the residential house of the high-rise resettlement community of the Wutongjun Community, they are allowed to purchase 20 square meters at a discounted price (RMB 4300 per square meter) based on the original normal applicable house type area. If they want to make further purchase, the price will be RMB 5000. 4) If the affected person chooses the residential house of the high-rise resettlement community of the in-progress Dongsheng Jiangjun Community, they are allowed to purchase 20 square meters at a discounted price (RMB 5500 per square meter) based on the original normal applicable house type area. If they want to make further purchase, the price will be RMB 6500. VII. Compensation policy for the tenants 1) The tenants of public-owned residential houses shall complete the housing variation procedure. When the procedure is completed, the acquiring party shall compensate and resettle the tenants at the standard applicable to the housing owner. If the entity directing managing the public property which is authorized by the government negotiates with the tenants of non-residential housing and decides to terminate the lease contract and select the monetary resettlement, the entity directing managing the public property and tenant shall be compensated based on 15% and 85% of the compensation expenses of the acquired houses, respectively. 2) The tenant and property owner of the private residential house should negotiate with each other. If the lease agreement concluded between the affected person and tenant has already set out the provisions on the acquisition and the corresponding solutions, such agreement should govern. If no provisions are made, the property owner should return the rental and deposit to the tenant, and compensate the tenant for the resulting decoration, relocation, business and other losses. The amount of compensation shall be determined by both parties in accordance with the agreement. 4.5.2 Enterprise Location Policy The enterprises affected by the acquisition in this project are resettled by monetary resettlement, and the price of monetary resettlement should be appraised and determined by the qualified property appraisal organization in accordance with the housing acquisition appraisal measure. The enterprise relocation compensation includes relocation costs (enterprise relocation and equipment relocation), and income loss during the plant production shutdown or 37 reduction. The affected employees will receive compensation for the salary during the production shutdown/transition period, and they have the priority to be reemployed after the enterprise relocation. In case of production shutdown and reduction due to the housing acquisition, if the business license is obtained, tax registration is completed and the taxation certification issued by the competent tax authority can be provided prior to the issuance of the housing acquisition notice, the affected people choosing monetary resettlement will be given the 6-month loss compensation based on the monthly average taxable amount, number of staff determined by the payment of labor insurance funds to the labor insurance authority and the average salary level of the staff in the city in previous year; and the affected people who choose the property swap shall be compensated for the losses on a monthly basis during the transitional period. For the enterprises which choose continuous operation, the governments at all levels will aid these affected enterprises in rebuilding or restoring the production, guiding and assisting them to find new places to realize industry transfer, upgrade and optimization. Any enterprise which is well developed is encouraged to start business in the industrial park to ensure to rebuild and resume the operation and production, and the affected employees will be provided with new or better job opportunities. 4.5.3 Compensation Policies for Attachments and Infrastructure The following 3 measures will be taken to restore the infrastructure affected by the project: 1) It will be directly restored by the railway construction enterprise during the construction process, such as rural roads and agricultural canals; 2) The railway operator shall engage professional teams to relocate such infrastructure at its own expense, such as communications facilities, power facilities, etc.; 3) Form some basic public infrastructure, such as drinking water tower and lighting lines, the railway operator will pay the compensation expenses to the affected parties, and the affected parties shall rebuild the infrastructure on their own. 4.5.4 Support for Vulnerable Groups Within the scope of the project relocation, vulnerable groups (people of low income and disability and tenants) will enjoy the following assistance: 1) For vulnerable group in the Project, whatever house structure is, those with a total building area less than 40m2 are entitled to a 40m2 indemnificatory house for free and own its property right.; if the relocated households desire to obtain the security house type larger than their original gross floor area, they may either pay the housing price at the cost of construction and installation or temporarily lease it at the cost rent until their improved economic conditions allow them to pay the housing price; 2) The residents holding the Minimum Living Security Certificate for Urban Residents shall be given additional RMB 20,000; and the disabled persons holding Certificate of Disabled Persons of the People’s Republic of China will have RMB 10,000 additionally. 3) Individuals holding certificate of minimum living security or certificate of disability are also entitled to get a living allowance of RMB 300 or above every month, which will be updated annually. 38 5. Compensation Standard and Resettlement Expense Budget 5.1. Compensation Standard 5.1.1. Compensation Standard for House Demolition of Urban Residents As for the compensation standard for house demolition of urban residents involved in the Project, the Compensation Scheme for House Requisitioned by the New Harbin-Jiamusi Railway (Jingyang Street to Nanzhi Road) Project is applied. Compensation for house demolition in this Project is realized in three ways: exchange of property right, money-based resettlement, and purchase of commercial residential house. Details are as follows: 1. Money-based Resettlement: 1) Price of the house requisitioned in the Project shall be determined by a recognized real estate price appraising agent with related measures for house demolition and appraisal; 2) If money-based resettlement is selected by the owner of the residential house requisitioned, compensation will be made to such owner at the rate of RMB 50,000 for each household (against the legal certificate of property right or certificate of lease); Up to the present, field survey on the houses to be demolished in the Project is finished and the price of houses in the affected area is RMB 4,485/m2 to RMB 7,562/m2 according to appraisal based on the plot, location, purpose, structure and age. 2. Exchange of Property Right: If the exchange of property right is selected for compensation, the “one resettlement house nearby for one requisitioned house, with the area close to that of standard houses� shall be followed based on the floor area registered in the legal certificate of property right of the requisitioned house. In the event that the resettlement houses are multi-floor buildings, the final resettlement house shall be determined by lot drawing according to the principle of “open, fair and just�. The resident shall, if the area of his/her requisitioned house is greater than that of the resettlement house, be paid with the actual price balance, or no price balance if the two houses are equal to each other in area; or contribute the price balance according to the comprehensive construction cost if the area of the requisitioned house is smaller than that of the resettlement house. If the resident ask for compensation by a resettlement house with floor area smaller than that of his/her requisitioned house, the area difference will be compensated with money at the appraised market price. In the event that the actual surveyed floor area of the resettlement house is different from that agreed in the related agreement, the resident shall contributed the balance price according to the construction and installation cost (if affordable house) or the comprehensive construction cost (if standard house) if the surveyed floor area is greater than the agreed area; or the resident shall be paid with the price balance according to the price for commercial residential houses if the surveyed floor area is smaller than the agreed area. See Table 5-1 for detailed standards and measures of resettlement compensation. When the expropriated families have an average floor area per capita lower than the standard for floor area per capita in our city for the previous year, those with a gross floor area of less than 40/m2 may get the property swap of 40/m2 security house types for free; if the relocated households desire to obtain the security house 39 type larger than their original gross floor area, they may either pay the housing price at the cost of construction and installation or temporarily lease it at the cost rent until their improved economic conditions allow them to pay the housing price. Purchase of Commercial Residential House: If the resident chooses resettlement by purchase of commercial residential houses, the requisition authority of Daowai District will, according to related policies about house requisition and exchange of property right, conclude a Compensation and Resettlement Agreement for House Requisition with such resident and later calculate the payables to such resident for purchase of house according to the market price of common similar commercial residential houses in the same area involved in the Project after deducting the payable price for the standard resettlement house. The market price of such commercial residential houses will be appraised and determined jointly by five or more appraisal agencies invited by the requisition authority, while the floor area is subject to the floor area of the standard house defined on the related requisition agreement. The payables to the resident for purchase of house will not be granted to such resident in money. Subsidies for house purchase will be granted to the resident at the rate of RMB 50,000 per household. In addition to the above money-base resettlement or resettlement with exchange of property right, the residents will be granted with following compensations for relocation: compensation for value of the requisitioned house and compensation for move and temporary resettlement due to the requisition of house; the compensation for demolition and relocation of residential houses includes the moving expenses, the expenses for access to TV, telephone and internet, and the compensation for house decoration. Compensation for non-residential houses includes the compensation for value of the requisitioned house and the 40 compensation for production/business halts, relocation and temporary resettlement due to house requisition; the compensation for demolition and relocation of non-residential houses includes the expenses for access to TV, telephone and internet, and the compensation for the relocation of machines, materials, gas, power and electrical facilities, and water facilities and equipments, the expenses of disassembling and re-assembling thereof, the residual value of equipments beyond recovery and re-use and the compensation for ground attachments. Details are as follows: A. Compensation Standard for Residential Houses: 1) Compensation for Relocation of Residential Houses: Lump sum subsidy will be granted at the rate of RMB 15.00 for each square meter of floor area of the requisitioned house if money-base resettlement is selected or RMB 30.00 for the same if resettlement by the exchange of property right is selected; together with subsidies including RMB 48.00 for telephone relocation, RMB 80.00 for cable TV relocation and RMB 120.00 for internet relocation; 2) Compensation for Temporary Resettlement of Requisitioned Residential House: Lump sum subsidy will be granted at the rate of RMB 20.00 per month for each floor square meter of the original house, for six months if resettlement with money-based resettlement, or resettlement with ready houses, or resettlement with purchase of commercial residential houses, commenced from the actual removal date of the original house; or if resettlement with the exchange or property right and the resident relocates at their own decision, resettlement subsidy will be granted by month for the transition period and be paid once per six months for 24 months; if longer than 24 months, subsidy will be granted at the rate of RMB 40.00 for each square meter of the original house for each additional month. The monthly compensation for temporary resettlement is shall be RMB 500.00 (if the calculated payable is less than RMB 500.00) or more. 3) Subsidy for Interior Finishing and Decoration of the Original House: This subsidy shall be determined jointly by the resident and the party requisitioning the house or by the authorized appraisal agent according to the file FLF [2009] No. 01. 4) Standard of Allowance for Poverty-stricken Families: Additional RMB 20,000 of allowance will be granted to each resident holding the Certificate of Minimum Subsistence Allowances for Urban Residents, and RMB 10,000 for the disabled holding the Certificate of the Disabled of the People’s Republic of China; 5) Standard of Indemnity Compensation for Residential Houses: Families with the per capita floor area lower than the average per capital floor area of the city in the previous year and the family’s total area less than 40 square meters and are incompetent to pay for the extra floor area (50 square meters minus the floor area of their requisitioned houses), they can choose the 40 m2 affordable houses for exchange of property right, with the area difference in the affordable house (greater than) and the requisitioned house being paid at the construction and installation cost, or at the cost rent temporarily and later pay the cost of construction and installation when affordable. 41 6) Standard of Rewards for Relocation: RMB 12,000 of rewards will be granted to each household (against a certificate of property right or a certificate of lease) in honor of their initiative relocation and acceptance check within the given reward period; or RMB 200.00 of rewards for each floor square meter of the original house in honor of their early initiative relocation and demolition of house within the given period. B. Compensation Standard for Non-residential Houses (Non-residential Houses Changed from Residential House Included): 1) Compensation for Relocation of Non-residential Houses (Non-residential Houses Changed from Residential House Included): Relocation expenses of TV, telephone and internet access will be calculated based on the regulations of related authority, while the expenses of relocation, disassembling and re-assembling of machines, materials, gas, power, electricity and water facilities will be calculated based on the actually incurred amount or RMB 30.00 for each square meter of the original house. Residual value of equipments beyond recovery shall be calculated on the replacement price and the residual age of service. 2) Compensation for Temporary Resettlement of Requisitioned Non-residential House (Non-residential Houses Changed from Residential House Included): Lump sum compensation will be granted at the rate of RMB 35.00 per month for each floor square meter of the original house, for six months if resettlement with money-based resettlement, commenced from the actual removal date of the original house; or if resettlement with the exchange or property right and the resident relocates at their own decision, resettlement subsidy will be granted by month for the transition period and be paid once per six months for 24 months; if longer than 24 months, subsidy will be granted at the rate of RMB 70.00 for each square meter of the original house for each additional month. 3) Compensation for Production/business Halts of Non-residential Houses (Non-residential Houses Changed from Residential House Included): In the event of production/business halts due to house requisition, 6 months of loss compensation will be made to the resident (if money-based compensation) based on the average monthly taxable income, the number of employees determined by the labor insurance authority according to the contributed consolidated funds for labor insurance, and the average wages of employees of the city in the previous year, if such resident has, before release of the notice for house requisition, obtained legal business license, handled tax registration formalities, and provided tax certificate issued by the competent tax authority; or loss compensation will be made by month during the transition period if resettlement by the exchange of property right is selected. The average monthly taxable income will be worked out by the tax authority according to the business income tax (individual income tax) in the previous year. 5.1.2. Compensation Standard for Demolition of Enterprises and Public Institutions 1) Subsidies for Stop-loss of Enterprises: In the event of production/business halts due to house requisition, 6 months of loss compensation will be made to the 42 resident (if money-based compensation) based on the average monthly taxable income, the number of employees determined by the labor insurance authority according to the contributed consolidated funds for labor insurance, and the average wages of employees of the city in the previous year, if such resident has, before release of the notice for house requisition, obtained legal business license, handled tax registration formalities, and provided tax certificate issued by the competent tax authority; or loss compensation will be made by month during the transition period if resettlement by the exchange of property right is selected. The average monthly taxable income will be worked out by the tax authority according to the business income tax (individual income tax) in the previous year. 2) Compensation for Relocation of Enterprises: Relocation expenses of TV, telephone and internet access will be calculated based on the regulations of related authority, while the expenses of relocation, disassembling and re-assembling of machines, materials, gas, power, electricity and water facilities will be calculated based on the actually incurred amount or RMB 30.00 for each square meter of the original house. Residual value of equipments beyond recovery shall be calculated on the replacement price and the residual age of service. Compensation standard for the dynamic electricity of enterprises is RMB 1,000/kw. 3) Compensation for Temporary Resettlement of Houses: Lump sum compensation will be granted at the rate of RMB 35.00 per month for each floor square meter of the original house, for six months if resettlement with money-based resettlement, commenced from the actual removal date of the original house; or if resettlement with the exchange or property right and the resident relocates at their own decision, resettlement subsidy will be granted by month for the transition period and be paid once per six months for 24 months; if longer than 24 months, subsidy will be granted at the rate of RMB 70.00 for each square meter of the original house for each additional month. 5.1.3. Compensation for Attachments and Infrastructure This Project will influence some roads, public projects and other infrastructure facilities. The Owner will require the Contractors to set up temporary facilities for protection during construction of the Project and recover the facilities damaged during construction. 5.2. Resettlement Expense Budget 5.2.1. Resettlement Budget The resettlement funds of the Project will be used mainly as compensation for demolition and relocation and other administrative fees. The expenses for infrastructure recovery will be accounted as the cost of engineering but not the total resettlement expenses. The total budget for resettlement in the Project is RMB 1,048,080,400, including RMB 887,780,000 (85%) as compensation for demolition and relocation and RMB 160,300,000 as other administrative expenses. Investment Funds for Resettlement and the Source of Funds The introduction of the Harbin-Mudanjiang Express Railway into the Project leads to the changes in the design proposal and further results in additional land requisition and house demolition. The investment funds for resettlement involved in the construction of the Harbin-Jiamusi Railway and the Harbin-Mudanjiang Express Railway are all raised by the local government. In which, the People’s Government of Harbin City becomes a shareholder of the railway by contributing the funds for land requisition and house demolition. Approximately 46% of the raised funds are used for land requisition and house demolition involved in the Harbin-Jiamusi (Jingyang Street to Nanzhi Road) Project, while the balance 53% used for the same in the Harbin-Mudanjiang Express Railway (the re-construction of Harbin Railway Station). The People’s Government of Daowai District of Harbin City is responsible to organize for the land requisition and house demolition work involved in the Project and the Demolition Office of Daowai District is responsible for execution of the aforesaid work, with related requisition and demolition expenses included in the total budget of the Project. The funds for land requisition and house demolition is partially raised and arranged by the government of Harbin City and partially loaned from recognized banks. 5.2.3. Management and Appropriation of Resettlement Funds The institution responsible for the compensation funds for house demolition is the People’s Government and the Demolition Office, of Daowai District, Harbin City. The resettlement funds are appropriated from the upper government to the lower government one by one and institutions at all levels will strictly observe the financial settlement and audit system, and check and report the status and utilization of the funds at regular intervals. Corrective and remedy measures will be taken in case of emergencies, so that to guarantee the scheduled appropriation and utilization of the funds. The funds will be appropriated in following procedures: 1) The Demolition Office of Daowai District concludes the compensation agreement for house demolition with the resident whose houses are to be requisitioned and take back the certificate of state-owned land use right and the certificate of house ownership of such resident. Later, the office will publish the by-household compensation details in the area involved in the Project. 44 2) If the resident prefers money-based compensation, the said office will submit the application for compensation funds for house demolition and the statement of detailed use of such funds to the city-level demolition office for approval. The city-level demolition office will, if the submitted application and statement are approved, give the bank a notice for release of compensation funds for house demolition. The district-level demolition office will then notify the resident to withdraw the compensation funds from the bank; 3) If the resident prefers resettlement with the exchange of property right, the district-level demolition office will submit the city-level demolition office with the house selecting proposal for the resettlement buildings and the details of houses available for resettlement. The city-level demolition office will, after filing the aforesaid proposal, arrange the resident to select the houses in an open way. The rewards for demolition and relocation and the subsidies for temporary resettlement will be granted in full amount when the residents relocate in given period. 45 6. Resettlement and Restoration The general objective of resettlement action plan of the Project is to provide the appropriate production/living measures and family development measures, so as to make the living standard recovered at least to the level no lower than the current one. The total principles of resettlement action plan of the Project are to resettle the families impacted in the original communities, respect and take care of production and living habits of the local resettlers, fully consider the desires of the resettlers, promote the nearby and humanized resettlement, recover the production and livelihood impacted, improve the living standard, thereby further maintaining the sustainable development of the resettlement area impacted. The special principles of resettlement planning are as follows: The planning layout shall be established according to principles of “beneficial for production, convenient for life�. All buildings to be relocated as plan, including dwelling houses, shall be subject to “nearby resettlement� in principle. The construction scale and standard for relocation and construction project shall be in accordance with the principles of recovering the original scale and standard. In combination with regional development, the investment for expanding the scale and improving the standard and long-range plan shall be solved by the local government and departments concerned. During relocation and resettlement, the resettlers will be concerned by the governments at all levels of Harbin City and Municipal Railway Construction Office. By way of full consideration and overall planning, the relationship among state, collective and individual will be handled well. By use of method of combining compensation, subsidization and production support, the local natural resource advantages shall be fully utilized, so as to gradually make the production and living standards of the resettlers reach or exceed the original ones. The families under woman’s control and families under man’s control shall have the same change and right for reconstruction of houses. Any behaviors of discriminating against families under woman’s control, such as reducing floor area or depriving them of rights, are totally illegal. The enough resources (funds and labor forces) shall be provided to guarantee that the families under woman’s control be satisfied with the demolition and have the suitable new residence. 6.1 Principles of Demolition and Resettlement of Residents’ Dwelling Houses The demolition involved in the Project is mainly related to the demolition of houses on the state-owned land; as for demolition of residents’ dwelling houses, the following resettlement principles shall be adhered: (i) The government is predominant, and the residents are voluntary. Under the leadership of municipal and district governments, the compensation and resettlement works shall be organized by law. By way of respecting the residents' desires, the voluntary selection shall be carried out for compensation and resettlement. (ii) Obeying laws and rules, being public and transparent. According to the national, provincial and municipal relevant laws and regulations, the procedures of publicity and announcement shall be implemented for guaranteeing the public policy, public building resources, public procedures and public results, thereby ensuring smooth progress of compensation and resettlement. (iii) Adjusting measures to local conditions, fully using the policies. The demolition and resettlement shall be in accordance with national, provincial and municipal policies, and combination with local conditions for adjusting the relevant 46 measures, thereby keeping continuity and stability of compensation and resettlement works. As for compensation for demolition and resettlement of residents’ dwelling houses in the Project, by adhering to the above principles of resettlement, various optional humanized compensation ways shall be adopted for carrying out the resettlement. As for implementation of house requisition, the compensation shall be firstly carried out, and then the relocation shall be implemented. The replacement of residents’ houses shall be realized completely, and the living standard shall not be reduced. 6.2 Principles of Demolition and Resettlement of Residents’ Non-dwelling Houses As for non-dwelling houses (incl. those changed from dwelling houses), such various ways as monetary resettlement, property right exchange in the area, specified by the government, independent purchase of commercial housings, etc. shall be adopted for resettlement. Besides compensation for operating loss during resettlement and compensation, the concern shall also be given to the non-property owner, i.e., the tenant. The objective of resettlement is to make the non-property owners recover their operations as soon as possible and receive the opportunity for sustainable development. 6.3 Principles of Demolition and Resettlement of Enterprises The enterprises placed into requisition shall be subject to evaluation according to market price by the independent professional evaluation authority, thereby determining the compensation fees. The compensations for industrial and mining enterprises impacted shall be calculated according to the replacement price of land, buildings, equipment and other attachments. The compensations shall include the relocation fees (relocation of enterprises and equipment) and loss of earnings during stop of production or reduction of output. The local resettlement departments shall adopt the following methods and procedures of demolition and resettlement for the industrial and mining enterprises: 1. Evaluation of fees: The Demolition Office of Daowai District shall employ the independent professional evaluation authority to evaluate the enterprises, thereby determining the compensation fees. 2. Payment of fees: the compensation fees shall be paid to the enterprises impacted; the relocation fees shall be paid, and the compensations for loss of earnings during stop of production and reduction of output shall be paid; the compensations for loss of wages and dynamic electricity during stop of production and transition period shall be paid. 3. Assistance for enterprise reconstruction and employment of staff: the governments at all levels shall give assistance to these enterprises impacted for reconstruction and restoration of production, guide and assist these enterprises to reselect the new location, actively help these enterprises implement the industry shift or industry upgrading and production optimization, encourage the enterprises with conditions to enter and station in the industrial park, and provide the employment opportunities for the staff impacted and improve the employment environment. As for enterprises without reconstruction plan, the resettlement department and enterprises shall notify the enterprise staff of enterprise resettlement methods within 6 months in advance, in order for reemployment of enterprise staff; meantime, the free training will also be provided and the employment will be recommended. 6.4 Demolition Impact and Restoration 47 6.4.1 Demolition and Replacement of Urban Residents’ Housings According to field investigation in communities, there is large difference in conditions of urban housings in the range of the route of the Project. According to community visit and interview with key insiders implemented by the investigation team, among residential housings for demolition, the housing conditions in Chengzhong Community under Sanke Office, Songguo Community under Taiping Office and Liangku Community under Lihua Office are very bad, these houses were constructed in 80's, and have not been repaired for many years, most of them lack the infrastructures, such as water supply and sewage, etc. The statistics in Table 6-1 show that the proportion of brick-concrete structure area is largest, averagely up to 74%. According to field investigation in communities, these housings involve large number of households, people and area, but the population in only 20% lives here, and the occupants are mainly the non-native lodgers (ragpickers, migrant workers in construction site, country-to-city migrant without definite prospects, etc.), instead of native residents living here for long time, and the house owners over 90% live in another place. In Xingye Community under Chongjian Subdistrict (Binjiang Xincheng Quarter) and Nankan Community under Nanma Subdistrict (Nankan Quarter), the houses are all the high-rise buildings with ten-year history and frame structures, and have the perfect living facilities and environment, and the per capita living space is 25m2. Due to small distance from original trunk railway, the house requisition and replacement shall be carried out as per scope of 30m of railway main line, so as to guarantee the living environment of the habitants. The total demolition area of residential housing is 67349.44m2, impacting 816 households and 2173 persons. The demolition and resettlement of urban residents shall be implemented according to Scheme of Compensation for Housing Requisition for New Construction of Harbin-Jiamusi Railway (Jingyang Street-Nanzhi Road Section). The values of housings placed into requisition shall be determined by the real estate price evaluation authority with corresponding qualification according to method of housing requisition and evaluation. The persons impacted by requisition can select the monetary resettlement, and also the house property right exchange. According to investigation, at the time of implementation of urban residents’ house demolition, the authorities in charge of implementing demolition shall publish the Announcement of Understanding Requisition Compensation for the PAPs in the communities to be demolished, so that 48 the residents impacted by requisition understand the differences in income from properties due to different compensation methods selected by them prior to house handover. As for residents’ dwelling houses, the Announcement specifies in detail the calculations of concrete amount of income from properties received by the residents in case of selecting such compensation methods as monetary resettlement and property right exchange in area specified by the government, and announces publicly the preferential policies enjoyed by the residents in case of selecting property right exchange in area specified by the government; moreover, as for non-dwelling houses (incl.those changed from dwelling houses), the Announcement specifies in detail the calculations of concrete amount of income from properties received by the residents in case of selecting such compensation methods as monetary resettlement and property right exchange in area specified by the government. The households to be demolished shall know the compensations they can acquire, thereby comparing and selecting their own resettlement desires. According to community visit and price investigation of peripheral house resource markets, we think that the complete replacement can be realized by way of implementation of the scheme, no matter which resettlement methods are selected by the PAPs. The statistics about replacement price comparison intervals are shown in Table 6-2. The figures 6-1/6-2 show the trends of market prices of houses in these area to be demolished. By way of price comparison, the persons impacted, which have selected monetary resettlement and independent purchase of commercial houses, completely can purchase the commercial housing with same area in same district within scope of compensation fees. According to current investigations, in the Project, the Taoci Quarter, Dongsheng Jiangjun (Daxin Street) High-rise commercial houses, Wutongjun (Shuiyuan Road) High-rise commercial houses already have been arranged for property right exchange of resettlement households. These quarters have enough house resources, and completely can satisfy the resettlement requirements of the Project. In addition, they will receive the compensations for settling-in allowances and fees for transition period; generally, the floor space for compensation is larger than original floor space no more than 15m2, and every household shall make a supplementary payment of RMB 46,800 according to highest standard of RMB 3,120. While, every household will receive various compensation fees no less than RMB 50,000, which are basically enough to make up a deficiency for excessive area in floor space for compensation in comparison with original one. Although the determination and site selection of house resources will be finally made after publicity of compensation schemes without objections, according to investigation of resettlement desires at the early stage, the PAPs are satisfied with these selected sites basically. The investigation of urban residents’ desires of demolition and resettlement is shown in Table 6-3. The detailed comparison of housing resettlement is shown from Figure 6-3 to Figure 6-7. The fact proves that the land acquisition and demolition in this district are able to not only make these residents receive considerable monetary resettlements or new houses with frame structure and area larger than original one, but also greatly improve the hygiene, environment, public security, transportation, etc. in this district, so the PAPs are anxious to implement the demolition as soon as possible. Seen from the support degree of the Project, the implementation of the Project has got the largest support of the persons impacted. For affected people choosing obtaining monetary compensation or purchasing commercial housing, resettlement policy guarantees their compensations based on housing evaluation (i.e. market value of housing appraisal), and can satisfy the market value of the ordinary commercial residential house of the same type on the same section in the project area. The market value herein only refers to housing value, excluding various incidental expenses incurred in the house trading process; According to the field survey, these settlements are sited first following the principle of relocation to nearby area, that is, in the same area under the jurisdiction sub district office: housing sources are all within 5km from the demolished ones. In the event that 50 relocated persons are unwilling to go there, they may choose the monetary resettlement or self-purchase commercial residential buildings, and as per the replacement costs standard, relocating in the same area by purchasing houses can maximally avoid the resettlement disputes arising from an increase of distance, medical seeking, school attending etc. It turns out that the land requisition and housing demolition in this area may not only enable residents to get considerable monetary compensations or larger new frame-structured houses than their original houses, but also greatly improve the sanitation, environment, public security and traffic etc. in this area; thus, ordinary people are anxious to carry out the demolition as quickly as possible. In terms of their support to the Project, its implementation has been greatly supported by the affected persons. The distinction will not be made according to building structures, and only the evaluation will be made according to area, thereby avoiding the too low compensation prices due to age-old and dilapidated houses. Even those persons selecting monetary resettlement also have the enough funds to purchase the houses with frame structure according to price per square meter in the same region; thereby the house replacement is realized completely. 2. The principle of resettlement first and demolition later are obeyed in the Project, in order to ensure that the PAPs firstly have selected the satisfactory resettlement houses prior to implementation of demolition of original houses, thereby greatly reducing the transient time of the PAPs impacted by demolition. Therefore, the demolition of the Project has few impact on the life of the PAPs; the PAPs selecting monetary resettlement can receive considerable compensation funds, and as for those persons selecting house replacement resettlement, their living environment is also improved. By way of interview with key insiders, the investigation team has understood the impact of the project demolition on their living, and investigated whether the impacted persons selecting different resettlement methods can realize the house replacement by means of demolition and resettlement. � Sun Youjie, Liangku Community, Lihua Subdistrict 53 year olds, females, 3 family members. Located in Gongyi Street, the house to be demolished is the staff quarter of vegetable company of Daowai District, constructed in the 90's, and has the brick-concrete structure and floor space of 150m2. At the beginning of 2000, in order to improve the housing quality, the whole family has moved to Chongjian Community, and this house has been leased to a foreign family from Province Hunan to work in Harbin; because the house is age-old and has simple decorations, he can receive the rent of RMB 1,000 every month. Because he already has 2 suites of houses nearby, so hopes to acquire the monetary resettlement; according to the principle of demolition compensation of the Project, it’s estimated that he can receive the compensation funds of RMB 1.160962 million. Mr Sun is very satisfied with the demolition compensation. According to the principle of monetary resettlement, Sun Youjie can actually receive the house compensation fees of RMB 8,073/m2, which is enough to purchase the commercial house with the same area in the same section. � Wang Minhong, Liangku Community, Lihua Subdistrict 56 year olds, females, 3 family members. The house to be demolished is located in Gongyi Street in Liangku Community. The house is of brick wood structure and an area of 27m2. In 2008, she has bought out the property right of this house by use of RMB 15,000; in 2000, in order to improve her family’s housing conditions, the whole family has moved to the adjacent street; currently, the 52 original house has been leased, and she can receive the rent of RMB 500 every month. Wang Minhong hopes to acquire the property right exchange for resettlement. According to the principle of demolition compensation of the Project, Wang Minhong can make a selection in many planned resettlement quarters nearby, and voluntarily purchases the excessive area in comparison with original house area. Although having her own dwelling house, Wang hopes to acquire a suite of new dwelling house, so as to increase the rent from RMB 500 to RMB 1000-1200 every month. According to compensation method of property right exchange in the Project, she can acquire for free a suite of dwelling house with an area of 40m2 or 50m2, which belongs to the scope of supportive housing area, and will purchase the excessive area in comparison with original house area as per a price of RMB 1,630/m2 (small high-rise building). She will make a supplementary payment of total amount of RMB 37,490 for the new house. But she actually can receive various moving subsidies with an amount of about RMB 40,000, which is basically enough to make up a deficiency for the new house. � Xu Shuzhi, Xingye Community, Binjiang Subdistrict 43 year olds, females, 3 family members. The house to be demolished is in No.3-3, G2 Building, Hao Minju Binjiang Xincheng. The house is of frame structure and an area of 64.58m2. In 2008, the whole family has moved into the house for living. According to meanings of Mrs. Xu, although the quarter has the complete facilities, and the work and living are convenient, the house is too close to Binjiang Station; therefore, she still wants to improve the living environment demand. According to the principle of demolition compensation of the Project, Xu Shuzhi can acquire the demolition compensation of about RMB 662,450, actually RMB 10,258 per square meter, which is enough to purchase the same commercial house in the same section. Mrs. Xu is very satisfied with such results. 6.4.2 Impact and Restoration of Demolition of Non-dwelling Houses Changed from Dwelling Ones According to site visit in community and interview with community cadres (interview with key insiders, etc.), there are 7 rooms under operation and 3 rooms unused among commercial houses to be demolished. And there are 5 rooms used as garage. Actually, a few population lives in this district, most of which are the old persons; due to bad business environment, the households still operating business can acquire a few of operating revenues of about RMB 1,000-3,000 monthly. According to investigations of operators still running business, among 7 shops changed from dwelling houses, 3 households are the property owner of shops, and 4 households are just the tenant of shops. According to investigation of desire for resettlement, 2 households have selected the property right exchange for resettlement, and other 5 households have selected the monetary resettlements. As for unused shop front and garage, the property owners all have selected the monetary resettlement. See statistics in Table 6-4 about impact, compensation amounts and resettlement methods of commercial houses to be demolished. The relevant photos are shown in Figure 6-8 - Figure 6-9: As for concrete compensation amount received by the tenant, the consultation shall be carried out with the property owner; in case that the prediction of house requisition has been made in the lease agreement signed by the property owner with the tenant, and the corresponding handling method has been specified, the compensation may be implemented according to the handling method specified in the lease agreement. She was originally the laid-off worker of Harbin Bridge Making Plant. Because she is the disabled, she has the difficulty in the livelihood; currently, she enjoys the minimum living security with an amount of RMB 100/month. In order for making a living and supporting her daughter for education, her own dwelling house with an area of 15m2 has been reconstructed as the shop front for groceries. She can receive the operating revenue of RMB 1,000/month. At present, her daughter has already graduated and taken a job, Mrs. Shang plans to close the grocery store and return to home for helping her daughter. By way of demolition and resettlement, in addition to acquiring the house compensation fees, because she is the disabled and household enjoying minimum living security, she can acquire an additional compensation fee of RMB 30,000 by virtue of Urban Resident’s Minimum Living Security Certificate and Certificate of the Disabled of the People’s Republic of China. It’s estimated that she can acquire the compensation fees of RMB 590 thousand, including house compensation fees. According to expressions of Mrs. Shang, in case of selecting monetary resettlement, she can not only use these compensation fees as a down payment of house-purchase of her daughter, but also leave tens of thousands as her own retirement allowance. In case of selecting property right exchange, she will acquire a suite of house with an area of 50m 2, and her current housing conditions will be improved without any additional money, with which she is very satisfied. 6.4.3 Enterprise Demolition Impact and Restoration In terms of the enterprises relocation, nine enterprises, or 21240 square meters will be relocated. Among these enterprises, 5 are out of business, and in the remaining four enterprises, 1 enterprise is partially demolished and its normal operations will not be affected. The other three ongoing enterprises will have to be completely demolished, with the aggregate demolition area of 1300 square meters and about 30 people will be affected. The enterprise demolition will be implemented by way of market evaluation and monetary resettlement. In addition to house demolition compensations, the enterprises still running business can also acquire various compensations, including compensations for six-month work stoppage loss and enterprise staff, as well as rewards for relocation and transition period. Most of these enterprises accept and understand such resettlement method. According to investigation, the vulnerable group involved in the demolition scope of the Project includes 131 persons. In the vulnerable group, 58 persons are the disabled, 68 persons belong to the household enjoying minimum living security, 3 persons belong to the household enjoying the five guarantees, and 2 persons belong to the destitute household. According to investigation, currently the welfare service for vulnerable groups and people subject to special care is the priority of construction and development of subdistrict/community in 5 subdistricts involved within the scope of the Project. In 5 communities investigated and visited, the community neighborhood committees have established such mass organizations as Association of the Aged People, Association of the Disabled, Association of Safeguarding Women’s Rights, Legal Aid Station, Stability Maintaining Center, Labor Guarantee Station, Minimum Living Security Relief Station, etc., completely covering the areas under jurisdiction of subdistricts. After establishment, such organizations can not only satisfy various needs of vulnerable groups in daily life as much as possible, but also guarantee the expression of desires and appeals of such personnel in such major issues as housing demolition, resettlement, etc. In the Project, the following policies are adopted to help and support the relevant vulnerable groups: 1) For destitute household and the disabled: the residents holding Urban Resident’s Minimum Living Security Certificate will receive a subsidy with an amount of RMB 20,000; the disabled holding Certificate of the Disabled of the People’s Republic of China will receive a subsidy with an amount of RMB 10,000. Such funds have been fully incorporated in the budget of land acquisition and demolition. 2) When the expropriated families have an average floor area per capita lower than the standard for floor area per capita in our city for the previous year, those with a gross floor area of less than40/m2 may get the property swap of 40/m2 security house types for free and own its property right; if the relocated households desire to obtain the security house type larger than their original gross floor area, they may either pay the housing price at the cost of construction and installation or temporarily lease it at the cost rent until their improved economic conditions allow them to pay the housing price; 3) Individuals holding certificate of minimum living security or certificate of disability are also entitled to get a living allowance of RMB 300 or above every month, which will be updated annually. 51 7. Resettlement Agency 7.1 Resettlement Regulatory Agency In order to fully strengthen the key railway project construction in Harbin City, the Organizational Structure Committee of Harbin City has already especially established the Leading Group of Promoting Works of Key Railway Project Construction of Harbin City as early as in June of 2014, in order to promote the implementation of relevant works of the railway project. The leading group shall still be responsible for management of promotion and coordination of Harbin-Jiamusi Railway Project (Jingyang Street-Nanzhi Road Section). The project leading group leader is Song Xibin, deputy secretary of municipal party committee and Mayor of municipal government; the leading group governs the office (hereinafter referred to as Municipal Railway Construction Promotion Office), and the member units include the Municipal Key Project Coordination Office, Municipal Railway Construction Office and relevant personnel from municipal departments. The relevant works are as follows: 1 Routine works of the leading group; 2 Overall planning, coordination and promotion of the municipal railway project construction; 3 Specific organization and promotion of railway project and related works determined by the department at levels of ministry, province and Harbin City; 4 Coordination and solution of important and difficult problems occurred during the project by way of communication with the relevant departments at levels of ministry and province. With rich experience in the housing demolition of urban residents, Daowai District Demolition Office has successfully carried out urban relocation of several domestic projects, demonstrating strong ability to deal with social resettlement. Relevant staffs are familiar with the national and provincial laws and policies on land requisition, housing demolition and resettlement; the World Bank’s policy on involuntary resettlement; and Chinese laws as well as the World Bank’s policy requirements on resettlement and compensation. They know clearly that both the Chinese law and World Bank’s policies have a target to ensure that the living conditions of the affected persons after the completion of the project can at least maintain the level before the project. In order to ensure implementation of resettlement action plan and be beneficial to groups impacted, the special training must be made for personnel of implementing agency, local Railway Construction Support Office and other organizations, so as to strengthen their plan and management capabilities. The training will be carried out by Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company, the training expenses will be paid by Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company, and the training teachers will be the resettlement experts with rich experiences in resettlement of World Bank financed projects. The training is divided into two parts: 1. The training will be carried out for the relevant personnel for resettlement and demolition in Daowai District; 2. The training will be carried out for the personnel of implementing agencies in various subdistrict offices and communities. The main contents of the training include: � National and local laws and regulations related to land acquisition and resettlement in China; � Policies and requirements of World Bank; � Resettlement action plan; � Relevant procedures of resettlement and land acquisition, as well as implementation experiences. The working expenses of resettlement agencies in governments at all levels come from the special management expenses of the Project, and generally is 1% of total cost of resettlement. The expenses for capability training of personnel from institutions of the project are also included in the management cost. Resettlement Implementation Plan 8.1 Implementation Principles of Resettlement Action Plan The implementation schedule of land acquisition, demolition and resettlement of the Project shall be in accordance with the planned construction schedule of the works; the implementation schedule shall be prepared according to following principles: (i) Principle of residents’ voluntariness Under the leadership of municipal and district governments, the compensation and resettlement works shall be organized by law. By way of respecting the residents' desires, the voluntary selection shall be carried out for compensation and resettlement. (ii) Obeying laws and rules, being public and transparent. According to the national, provincial and municipal relevant laws and regulations, the procedures of publicity and announcement shall be implemented for guaranteeing the public policy, public building resources, public procedures and public results, thereby ensuring smooth progress of compensation and resettlement. During demolition and resettlement, the great attention shall be paid to the public participation; and the the grievance and complaint shall be handled timely and quickly; (iii) The demolition and resettlement shall be in accordance with national, provincial and municipal policies, and combination with with local conditions for adjusting the relevant measures, thereby keeping continuity and stability of compensation and resettlement works. The principle of resettlement first and demolition later shall be obeyed; (iv) The great attention shall be paid to the expression of interests and support of vulnerable groups during demolition; it shall be practically guaranteed that the livelihood of households demolished are restored and improved as soon as possible. The procedures of relocation and reconstruction of houses of resettlers of the Project are shown as follows: 1) The scope with houses to be demolished due to the project shall be provided by China Railway Third Survey & Design Institute Group Co., Ltd; 2) The house requisition plan shall be prepared by Daowai District People's Government and Daowai District Demolition Office; 3) The relevant formalities of house requisition shall be handled; 4) The real estate price evaluation authority shall be selected; 5) The bidding and tendering of enterprises responsible for house demolition shall be organized; 6) The house investigation and registration shall be organized; 7) The requisition compensation scheme shall be prepared, demonstrated and published; 8) The funds for requisition compensation shall be measured, calculated and stored; 9) The requisition compensation scheme shall be modified and recorded; 10) The house resources for property right exchange shall be determined; 11) The decision of house requisiton shall be made; 12) The mobilization meeting for house requisition shall be convened; 57 13) The requisition compensation agreement shall be signed; 14) The compensation decision shall be made, and the compensation agreement shall be executed; 15) The old houses shall be demolished. 8.2 Resettlement Implementation Schedule Up to now, the thorough investigation has been launched in the areas to be demolished in the Project, and the demolition proclamation of the Project has been announced in such major media as official website of Harbin People's Government, Harbin Daily, etc. According to municipal demolition management procedures and work plan, the demolition compensation scheme of the Project will be published with a duration of one (1) month, and the house demolition works of the Project will be carried out after the demolition compensation scheme is recorded into file without any objection. The demolition mobilization meeting of the Project shall be convened in November of 2016, the demolition compensation agreement shall be designed in December, the compensation decision shall be made, and then the old houses shall be demolished. The whole demolition works are to be completed in this year, and the resettlement of households demolished are to be completed in the first half of 2017. The construction period of the Project is about 4 years, the land acquisition and demolition are to be launched in October of 2016, and the land acquisition & demolition and resettlement are to be completed in June of 2017. Consultation, Public Participation and Grievance 9.1 Public Participation and Consultation The public participation and consultation are one of major contents during preparation of resettlement action plan. The main activities subject to public participation include the consultation with local government and related departments, field impact investigation, social economic investigation and social evaluation. As for project optimization design, impact investigation and restoration measures, the wide and in-depth discussion and consultation have been carried out for many times. All these contents are reflected during consultation. Once the scheme adjustment of Jingyang Street-Nanzhing Road Section Project is determined, the Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company, design organization, Municipal Railway Construction Office and Demolition Office of Daowai District carry out the communication with subdistricts and communities impacted according to principle of consultation. After the demolition red line of the project is determined, the Demolition Office of Daowai District has carried out the field thorough investigation, successively executed the consultation and communication with communities impacted and community representatives for many times, so as to hear their opinions and suggestions. The spirit of consultation will always be carried through the demolition and resettlement of the Project. 9.2 Identification of Project Stakeholders According to feasibility study documents of the Project prepared by China Railway Third Survey & Design Institute Group Co., Ltd, the identified stakeholders/groups related to the Project are shown as follows: � China Railway: Project Owner, sponsor, borrower of World Bank loan; � Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company: the Company is an agency specially established by China Railway for engineering management of Harbin-Jiamusi Railway project and Harbin-Mudanjiang Railway project, and responsible for bidding and tendering of Harbin-Jiamusi Railway and Harbin-Mudanjiang Railway, supervisory management of construction activities of construction contractor, coordination and cooperation with various local governments at all levels and related organizations, so as to jointly finish various tasks of the Project, such as land acquisition, demolition, resettlement, etc. In Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company, due to actual needs of project management, two (2) independent teams are established, and responsible for management of Harbin-Jiamusi Railway and Harbin-Mudanjiang Railway respectively. Because the Harbin-Jiamusi Railway will use the foreign capital loan, the Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company will be put in charge of construction team of Harbin-Jiamusi Railway, and especially appoint the personnel to be responsible for resettlement, engineering management, environmental supervision, financial management, etc. of the Project. � Harbin Municipal People's Government: one of the Project Owners, using local financial funds invested in land acquisition & demolition and resettlement in the project area in the territory as investment of the Project; investor of the Project, using local finance invested in demolition and resettlement in the project area as project investment; and beneficiary of the project benefit. The government not only bears the construction cost, such as land acquisition, demolition, resettlement, etc., and guarantees the normal construction activities of 61 construction teams in the project area, but also undertakes the important responsibilities of maintenance and development of rights and interests of village groups and villagers in the project area. � District governments impacted by the Project: such governments undertake the concrete implementation of demolition and resettlement, not only are the beneficiary of the project construction, but also bear the important responsibilities at various stages, such as project preparation, construction, etc. Such governments are responsible for the concrete implement of demolition and resettlement, payment of compensation fees, guarantee of normal order of engineering construction, conciliation of various contradictions and disputes occurred due to project construction, maintenance of local social order and rights and interests of enterprises and residents in the project area and so on. � World Bank: World Bank provides the loan for the Project; � Enterprises and public institutions impacted by the Project: including enterprises, public institutions, commercial shops, etc. impacted by the Project, as well as groups directly impacted by the Project; � Communities and individuals impacted by the Project: including communities and individuals impacted by land acquisition and demolition, which are the groups impacted directly by the Project; � Contractor: construction contractor undertaking the construction tasks. 9.3 Stage, Way and Content of Public Participation The public participation in the Project is reflected in the following aspects: 1) Public participation during project preparation; 2) Public participation during resettlement implementation; 3) Public participation during project construction; 4) Public participation in monitoring and evaluation after completion of the project. The main content for participation includes: The public participation is one of important and essential steps in engineering survey and design. By way of carrying out the thorough field investigation and convening various consultation meetings for seeking opinions and widely collecting requirements of all parties for the Project, and fully consulting with government functional departments and signing agreements, the survey and design organization solves other series of issues to be considered necessarily at the early stage of construction. The public participation is also the important link in the evaluation process. In the process of preparation of report on resettlement action plan, the design agency, resettlement action plan preparation agency and local related government department have grasped the problems generally concerned by the PAPs impacted by way of in-depth investigation. By way of holding informal discussions, issuing questionnaires and carrying out door-to-door visits, the people of different classes have participated in and initially understood the Project. By way of investigation of households impacted by demolition, such detailed conditions as family members, floor space, family incomes and expenditures, housing conditions, family durable goods, etc. have been understood, the impact of demolition on them has been analyzed, and their opinions on resettlement and attitudes towards construction of the Project have been heard. In the process of implementing resettlement population investigation, the public 62 participation must be one part of resentment plan, and after then also be one part of inspection and evaluation. The process of project construction is also the process of public participation. During project construction, groups impacted may acquire the employment opportunities brought by the project construction and participate in the construction activities of the Project. During and after project construction, the monitoring and evaluation also need the participation of the public, and the power and benefits of the public shall also be guaranteed in the process of participation. During monitoring and evaluation, the investigation and evaluation also need the participation and support of the public. 9.4 Public Participation at Project Preparation Stage 9.4.1 Meetings at Resettlement Action Plan Preparation Stage As for Harbin-Jiamusi Railway Project, after addition of Jingyang Street-Nanzhi Road Section Works, the governments at all levels and related functional departments of Harbin City have convened various meetings, in which a series of problems have been discussed in order to evaluate the quantity of persons, organizations and enterprises impacted, and the degree of impact and compensation methods also have been discussed. Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company, Harbin Railway Construction Office, Demolition Office of Daowai District and relevant personnel responsible for resettlement in subdistricts and communities impacted have organized many meetings and assembled the community cadres and demolition representatives to hold meetings with public participation about project implementation, resettlement execution and resettlement compensation, in order to carry out publicity and announcement of the Project and hear the opinions of the PAPs on resettlement. The resettlement schemes in accordance with desires of persons impacted have been determined by way of hearing and adopting the opinions of the PAPs. See Table 9-1 for topics of discussion, content and participants of the meetings held actually. In addition, the Daowai District People's Government has announced the key information about demolition of the Project to the PAPs through such mainstream media and channels as Harbin Daily, official website of Harbin Municipal Government. In July and September of 2016, the House Requisition Office of Harbin Municipal People’s Government has officially announced the house requisition information involved in the Project; see Figure 9-1 for details. The sampling investigation has been carried out by way of informal discussion and door-to-door interview for 250 households from all households demolished, accounting for 30.6% of all households impacted. The goal of sampling for public opinion investigation is to understand the opinions and suggestions of households demolished in communities impacted on the engineering construction and resettlement of the Project. In general, the respondents express that the Harbin-Jiamusi Railway Project would produce the positive meaning in aspects of making transportation more convenient and improving family’s living environment and is the project with positive influence on public benefits and personal benefits; 94% of respondents express their support to the Project, 5.2% of respondents express their conditional support, and 1% of them do not care about the Project. As for respondents with conditional support, the considerations lie in whether the policy and scheme of demolition and resettlement meet the personal appeals. Some households demolished express their worry about impact of demolition and transition, compensation payment and project construction on their travel and traffic, and meantime put forward their own opinions and ideas about scheme of demolition and resettlement. The most of people have gained some understanding by way of neighbor chitchat to ask about the demolition and resettlement method of other project, and had no idea about the concrete scheme of the Project. The main subject of the meeting is to explain the scope, location and time of land acquisition and demolition of the Project, national and local regulations and policies related to land acquisition and demolition, compensation standard and resettlement measures for house demolition, and living training needs and plans, and hear the opinions and suggestions of attendees. The meetings are usually held at the time of demolition implementation and signature of compensation agreement. In addition, the Daowai District People's Government and Demolition Office already have arranged the population impacted and stakeholders to participate in the public hearings prior to resettlement implementation in advance at least one (1) month. After then, the investigation has been carried out for determination of quantity of houses subject to requisition of the persons impacted, which has been announced by a proclamation; the physical impact quantity has been determined by signature of both 67 parties; in addition, the resettlement compensation standard involved in the Project is also announced publicly, with a publicity duration of one (1) month, in order to extensively collect opinions and appeals of households to be demolished. The standard is also subject to modified in combination with public opinions and kept on record. 9.6 Propaganda and Information Release At early stage of project preparation, the propaganda and information release have been carried out; the resettlement mass meeting is also one main form of information release. The purpose of such meeting is to make the attendees preferentially know the conditions of land acquisition implementation, compensation policies and standards, personnel resettlement countermeasures, and meantime collect the feedback information of the attendees. By way of project information release and resettlement action plan announcement in such various media as broadcasting, television, newspaper, magazine, etc., the followings shall be widely propagated to the PAPs: purpose and meaning of project construction, time and location of project construction, detailed stipulations for implementation of demolition policies established by provincial and municipal governments at all levels, as well as resettlement compensation standards and resettlement scheme of the Project. The purpose of propaganda and announcement is to make the PAPs know the issues related to land acquisition and demolition of the Project. Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company would adopt the following methods of propaganda and information release for resettlement of the Project: 1) Within July-September of 2016, the announcement on house requisition of the Project have been published in Harbin Daily and official website of Harbin Municipal People’s Government; 2) In October of 2016, the proclamation have been posted up in subdistricts and communities impacted to announce the basic contents of demolition, compensation standard and resettlement scheme of the Project, in order to make the PAPs impacted understand the basic circumstances of the Project and their own rights and interests. The publicity duration is one (1) month. 3) In January of 2017, the information handbook Supplemental Resettlement Action Plan of World Bank Financed Harbin-Jiamusi Railway Project (Jingyang Street-Nanzhi Road Section) will be published on the local mainstream media with a publicity duration of three (3) months. After announcement and propaganda by use of above-mentioned three ways and channels, it can be guaranteed that most of the PAPs in the impact areas clearly know and understand the basic circumstances and relevant issues of demolition of the Project through their own convenient channels. The wide coverage of information spreading and large number of audiences can be guaranteed. 9.7 Grievances and Complaints 9.7.1 Grievances and Complaints Channels The resettlement is a complicated mission. In the process of resettlement implementation, the discontents and complaints will appear unavoidably among the persons impacted. In order to guarantee the benefits of persons impacted, the resettlement office will build up a set of highly transparent simple procedures of collecting and handling discontents and complaints, so as to objectively, equitably and efficiently handle discontents and complaints of the PAPs, thereby ensuring the smooth progress of resettlement. 68 The major methods of collecting discontents and complaints against resettlement of the Project are shown as follows: � Discontents of impacted persons reflected from the local resettlement offices, including discontents of the mases, schedules, working measures and existent problems. � All Contractors shall submit the construction journals every week to the Project Owner, from which it can be known whether someone has influenced the construction. � Resettlement problems found by Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company by way of site inspection. � Related information reflected by IMO. � Telephone or letter complaints from the persons impacted. � Relevant special problems reflected by audit department and discipline inspection department. � Internal and external monitoring. 9.7.2 Grievance Procedure Stage 1: The persons impacted may propose their complaints to the Demolition Office of Daowai District in form of oral compliant or written compliant. The Demolition Office of Daowai District must keep the written records of oral complaints and reply clearly within two (2) weeks. Feedback acceptance department: House Requisition Office of Harbin Municipal People’s Government Grievance accepter: Wang Liyu Tel: 0451-87597116 Stage 3: If the persons impacted dissatisfy the reply from stage 2, they can apply for administrative reconsideration or lodge an administrative action within fifteen (15) days after receiving the reply from House Requisition Office of Harbin Municipal People’s Government. 9.7.3 Grievances and Complaints Handling Principles and Methods The Resettlement Office of Daowai District People’s Government shall carry out the investigation and research for public discontents, and provide the results and fair solutions after well considering and patiently discussing the public opinions according to relevant national laws and principles and standards in Resettlement Action Plan. The grievance out of handling capability shall be submitted to the resettlement office 69 at higher level and give assistance to investigation. In case that the policy-making agency does not make the reply within the date specified, the case on appeal shall have the right to be appealed further to higher level. During resettlement, the women may have some special discontents and complaints, so the resettlement office shall arrange at least one female working personnel at every resettlement team, so as to handle the complaints from women. At the same time, the Women's Federation also will supervise the resettlement activities, and guarantee the smooth progress of resettlement action plan, especially the rights of women. The main contents of reply include: 1) Introductions of grievance and complaints; 2) Results of fact-finding; 3) Related national regulations and principles and standards in Resettlement Action Plan; 4) Solutions and reference standards; 5) The complainant shall have the right to appeal to the higher level resettlement office and civil court. The reply shall be made as below: 1) The reply of exceptional case on appeal shall be submitted to the complainant in written form. 2) The reply of usual case on appeal shall be announced to the villages or groups concerned by way of convening villagers’ meeting or issuing documents. 3) The replies in any form shall be submitted to the resettlement office to which the grievances belong. In addition, during resettlement implementation, the resettlement office shall record the grievances and its solutions, and make report to the Provincial Project Office in written form monthly. The Provincial Project Office shall periodically check the records of grievance solutions and relevant circumstances. In order to standardize the grievance records and completely register the grievance, the Demolition Office of Daowai District has already drawn up a format table, in order to record or register the grievance and its solutions. See Table 9-7 for details. Monitoring and Evaluation In order to ensure smooth implementation of Resettlement Action Plan and realize the purpose of resettlement, the monitoring shall be carried out for the whole process of land acquisition, demolition and resettlement of the Project. The monitoring is divided into two parts, which will be carried out respectively, i.e., internal monitoring of resettlement agency and independent external monitoring. The internal monitoring is carried out by the resettlement agencies at all levels, and the external monitoring is carried out by entrusting the independent and fair third-party organization with experiences in monitoring and evaluation of World Bank financed projects for over 5 years, thereby carrying out the monitoring and evaluation of land acquisition, demolition and resettlement of the Project. 10.1 Internal Monitoring 10.1.1 Purpose and Task The Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company will build up the database of land acquisition, demolition and resettlement, in order to carry out the internal supervisory inspection of entire process of resettlement preparation and implementation according to Resettlement Action Plan approved by World Bank. 10.1.2 Agency and Personnel The internal monitoring of project land acquisition, demolition and resettlement will be directed by Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company, and implemented by Daowai District Railway Construction Office, Daowai District Demolition Office and Subdistricts Offices. In order to effectively carry out internal monitoring function, the resettlement agencies at all levels are arranged with specially-assigned persons to be engaged in such works; such persons have already participated in the preparation and implementation of Resettlement Action Plan, and carry out the internal monitoring control in accordance with the process of execution and implementation of Resettlement Action Plan. 10.1.3 Monitoring Contents and Procedures The main contents of the internal monitoring include: � Introduction of progress of Harbin-Jiamusi Railway (Jingyang Street-Nanzhi Road Section) � Appropriation and use of resettlement compensations; (different from Harbin-Mudjanjiang High-speed Railway Construction Project) � Progress and effect of house demolition and resettlement; � Support for vulnerable groups; � Resettlement of enterprises and commercial shops; � Restoration of special facilities; � Timetable of above-mentioned activities; � Implementation of regulations in policies of Resettlement Action Plan; � Participation and consultation during resettlement implementation; � Manning, training, work schedule and operation of resettlement agencies at all levels. (different from Harbin-Mudjanjiang High-speed Railway Construction Project) 71 The Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company will develop an internal monitoring frame to monitor the resettlement activities, and build up a database for land acquisition, house demolition and resettlement, and supervise the whole process of resettlement. During project implementation, the Demolition Office of Daowai District will build up the relevant database and track the progress of resettlement for timely updating, thereby assisting Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company to update the resettlement works. They will also timely exchange the records of activities in progress, report the progress of resettlement implementation to the higher level resettlement office, so as to realize the continuous monitoring. The Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company will inspect and audit the resettlement in stages. The Company will draw up a schematic progress report every half year and submit it to World Bank. 10.1.4 Submission of Internal Monitoring Report After start of resettlement, the resettlement progress report shall be submitted at least once every three months to the resettlement office at higher level from the one at lower level. According to reports submitted by the resettlement offices at all levels, during resettlement implementation, the project resettlement office will submit a brief report every half year to World Bank, in order to express the progress of resettlement. 10.2 External Monitoring 10.2.1 Purpose and Task The external monitoring and evaluation will be carried out mainly for land acquisition & demolition and resettlement activities once every half year from outside of the resettlement agency, in order to evaluate whether the purpose of resettlement is achieved. By way of external monitoring and evaluation, the evaluation opinions and suggestions can be provided for entire resettlement process and restoration of production and living levels of the resettlers, the warning system can be provided to the engineering management department, and the reflection channel can be provided for the opinions on resettlement. The external monitoring agency will take post of consultant of coordination team o land acquisition & demolition and resettlement of China Railway and Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company, carry out the tracking, monitoring and evaluation of implementation of Resettlement Action Plan and put forward the policy-making consultation opinions. 10.2.2 Agency and Personnel Prior to commencement of project land acquisition and demolition, the Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company will entrust the independent and fair third-party organization with experiences in monitoring and evaluation of World Bank financed projects for over 5 years by way of bidding, in order to carry out the monitoring and evaluation of land acquisition, demolition and resettlement of the Project. The external independent monitoring agency shall carry out all basic monitoring works by means of providing technical assistance to Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company and implementing resettlement investigation and living standard investigation of persons impacted according to regulations. 10.2.3 Contents and Method of External Monitoring The main indicators for external monitoring of resettlement include: 72 A. Main indicators for monitoring: (1) Progress: including preparatory works of land acquisition, demolition and resettlement, implementation of land acquisition and demolition, resettlement, etc. (2) Quality: including engineering construction quality, degree of satisfaction of resettlers, etc. during implementation of land acquisition, demolition and resettlement. (3) Investment: including appropriation and use of funds for compensations of land acquisition, demolition and resettlement. B. Main indicators for evaluation: (1) Resettlement a. Economic conditions: family economic development before and after resettlement, including possession of means of family production and living, and properties, incomes, etc.; b. Environmental conditions: living environment before and after resettlement, including development and change of utilities, such as traffic, education, hygiene, commercial service, etc.; c. Employment: change in occupations before and after resettlement, employment rate of labor force, provision of assistances to various objects, especially to destitute household; d. Community development: economic and environmental development of local villages after movement to new resettlement quarters, and conditions of interpersonal relationships, public opinions. (2) Infrastructure: changes of infrastructures in the area impacted by the Project before and after project implementation; (3) Enterprises and commercial shops: changes of business environment and business state of enterprises and industrial and commercial households before and after resettlement. C. Sampling requirement and proportion As for persons impacted directly by the Project, in the external monitoring of resettlement, the households demolished no lower than 15% shall be sampled for investigation, and it shall be guaranteed that the women, poor households and vulnerable groups with a proportion of no lower than 30% of sampled households are included in the public participation activities of the Project. 10.2.4 External Monitoring Report 1) Resettlement action plan report The Resettlement Action Plan (RAPs) of the Project has been prepared in September of 2016, and submitted to World Bank or evaluation. 2) Resettlement progress report; From commencement of land acquisition, demolition and resettlement, the resettlement agencies at all levels shall submit the work progress report once every three (3) months at least to the higher level resettlement agency (internal monitoring report), the Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company then shall summarize and collate the materials about 73 implementation of land acquisition, demolition and resettlement in its jurisdiction every half year according to the work progress report submitted by the resettlement agencies at all levels, in order to prepare the Resettlement Progress Report and submit it to World Bank 3) Independent resettlement monitoring and evaluation report The external monitoring agency will periodically submit the external independent resettlement monitoring and evaluation report to World Bank through Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company annually. According to World Bank’s requirement, from commencement of implementing land acquisition, demolition and resettlement, the external monitoring and evaluation agency shall, by way of the Owner, periodically submit the external independent monitoring and evaluation report to World Bank, carry out the monitoring and evaluation investigation for 1-2 times according resettlement progress, and submit the resettlement monitoring and evaluation report. The project section listed in the Report is a newly added part in the newly-built Harbin-Jiamusi Railway Project after design adjustment, the scope of works and resettlement impact of this project section have still not been included into the original Resettlement Action Plan; therefore, the external resettlement monitoring agency shall prepare the independent external resettlement monitoring report for resettlement activity in this section and its progress, and submit the report to World Bank for review within the specified time. 10.3 Resettlement Post Evaluation After completion of project land acquisition and demolition, on the basis of monitoring and evaluation, the theory and method of post project evaluation shall be utilized to carry out the post-evaluation for resettlement activity. The evaluation shall be made for successful experiences in land acquisition, demolition and resettlement, as well as lessons worthily learned, in order to provide the useful experiences for resettlement in future. The post evaluation shall be carried out by external independent monitoring and evaluation agency entrusted by Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company. The agency undertaking the post evaluation shall prepare the post-evaluation work program and establish the evaluating indicator system; in addition, the agency also shall carry out the social economic analysis and investigation, in order to prepare Project Resettlement Post Evaluation Report. 74 11. Resettlement Information Handbook and Power Matrix Table Resettlement Information Handbook of Harbin-Jiamusi Railway Project (Jingyang Street-Nanzhi Road Section) I. Project Contents Harbin-Jiamusi Railway passes by two cities and three counties, with the total length of 343km, including the 336.8km new lines, 179.435km mainline subgrade, 154.064km mainline bridges and 9.845km mainline tunnels, with the bridge-tunnel ratio of 47.74%. There are 15 stations along the line, including 13 new intermediate stations. Harbin-Jiamusi Railway Project was commenced on July 10, 2014, with the period of 2014 to 2018, or totally 4.5 years. Harbin-Jiamusi Railway Project has a total budget of RMB 38.6 billion, which was jointly funded and constructed by China Railway Corporation and local government. The new Harbin-Jiamusi Railway Project (Jingyang Street to Nanzhi Road Section) utilizes the existing lines for renovation, and the mainline is 5km long, which is a double-track electrified railway. The whole line has totally 2 stations, Binjiang and Taipingqiao. It passes by the 7 subdistricts, 10 communities and 2 stations (Binjiang Station and Taipingqiao Station) of Daowai District, Harbin. II. Project Impact All lands used for construction of Harbin-Jiamusi Railway Project (Jingyang Street-Nanzhi Road Section) is state-owned, and don't involve the acquisition of collective land. Due to project impact, the total demolition area of urban residential housing is 67349.44m2, impacting 816 households and 2173 persons. 15 households are involved in the demolition of non-dwelling houses changed from dwelling houses, with a demolition area of 939.4m2. The enterprise demolition involves 9 enterprises, with a demolition area of 21,240m2. The demolition totally impacts 5 subdistricts and 7 communities. In addition to house demolition, the project impact also involves the demolition of attachments, relevant equipment and infrastructures in various buildings, as well as buildings reserved to be demolished because of noise vibration and environment influence. III. Eligibility for entitlements In accordance with relevant laws and the World Bank’s safeguard policy OP4.12 requirements, the new Harbin-Jiamusi Railway (from Jingyang Street to Nanzhi Road) Project will involve the following groups, who are eligible for resettlement and compensation pursuant to this Resettlement Action Plan: 1) Urban residents affected by the demolition; 2) Demolished house tenants (including residence, residential/commercial house, and enterprise tenants); 3) Enterprises; 4) Public infrastructure property owners; and 5) Vulnerable groups IV. Resettlement Compensation Standard In the Project, the compensation standard for house demolition of urban residents shall be implemented according to Scheme of Compensation for Housing Requisition for New Construction of Harbin-Jiamusi Railway (Jingyang Street-Nanzhi Road Section). In the Project, there are three methods of 75 resettlement for house demolition, i.e., monetary resettlement, property right exchange and independent purchase of commercial house. The detailed standard of house demolition and resettlement are shown in Part VII Right Matrix Table in this handbook. V. Resettlement and Livelihood Restoration The general objective of resettlement action plan of the Project is to provide the resettlement houses in accordance with local actual housing conditions and humanized resettlement policies, so as to make the living standard recovered at least to the level no lower than that before the project. In the Project, the measures for compensation and resettlement of house demolition will not be limited to monetary resettlement, the property right exchange for resettlement can also be selected, so as to ensure the restoration and improvement of living standard of the resettlers. The principle of resettlement first and demolition later shall be obeyed during house demolition. The detailed resettlement policies are shown as follows: A. Policy of monetary resettlement for resettlement: In case of selecting monetary resettlement, the amount of compensation shall be evaluated and determined by the selected evaluation company according to methods of house requisition and evaluation in consideration with such factors as location, purpose, building area, cause of formation of houses subject to requisition. The compensation standard for values of houses subject to requisition shall not be lower than the market price of real estate similar to houses subject to requisition in the date of announcement of deciding house requisition. Except that the government has specially established the price of houses for property right exchange, the values of houses subject to requisition and houses used for property right exchange shall be evaluated and determined by the evaluation agency with corresponding qualification according to the relevant stipulations. The evaluation agency shall be determined through consultation by the persons with houses subject to requisition or representative of persons with houses subject to requisition within the specified time; in case of failure of consultation, the house requisition department in the district shall organize the persons with house subject to requisition to determine the evaluation agency by votes according to principle of minority subordinating to majority by way of voting. Or, the methods of lottery, drawing-lots, etc. shall be adopted to determine the evaluation agency, and the notarization department shall notarize the process and results of drawing-lots. In case of monetary resettlement for dwelling houses, every household on the basis of one legal property right certificate or leasing certificate shall be paid with a subsidy of RMB 50,000. B. Property Right Exchange in Area, Specified by Government 1) According to building area indicated clearly in the legal property right certificate of dwelling house requisitioned, once one household is requisitioned, the property right exchange is made with the nearby standard house type with larger area than that of original house. 2) In the Project, the Taoci Quarter, Wutongjun Resettlement Quarter with high-rise commercial ready house and Dongsheng Jiangjun Resettlement Quarter (Daxin Street) with high-rise commercial ready house have been arranged for selection of household subject to 76 resettlement. The building area of resettlement house in standard type includes 40 ㎡, 50 ㎡, 60 ㎡, 70 ㎡, 80 ㎡ and 90 ㎡; as for equal area of house for property right exchange to original house, the price difference will not be calculated for such area, the area exceeding that of original house will be purchased by persons with house requisitioned according to comprehensive construction cost; if the persons with house requisitioned wants the property right exchange with house with area less than that of original house, the excessive area of original house against area of houses used for property right exchange will be subject to monetary resettlement according to evaluated market price. The differential part between actually measured building area of house for property right exchange and agreed building area shall be subject to calculation of price difference, i.e., the part of actually measured area of house for property right exchange exceeding the agreed area shall be purchased by the person with house requisitioned according to either construction and installation cost in case of minimum level indemnificatory house type, or comprehensive construction cost in case of standard house type. As for part of actually measured building area of house for property right exchange less than agreed building area, the monetary computation will be made to persons with house requisitioned according to price of commercial house. C. Policy of Independent Purchase of Commercial House for Resettlement: 1) If the persons with house requisitioned select the resettlement by way of independent purchase of commercial house, the requisition department of Daowai District shall sign House Requisition Compensation and Resettlement Agreement according to policy of property right exchange for house requisition with such persons, and calculate the monetary funds for independent purchase of commercial house received by such persons through monetary resettlement according to market value of ordinary commercial house with same location and type in the requisition project after deduction of amount for purchase of house in standard type with area larger than that of original house; the market value of commercial house in requisition area shall be evaluated and determined jointly by the requisition department together with over five evaluation agencies, and the house building area shall be the building area of house in standard type with area larger than that of original house agreed in the requisition agreement. The received monetary funds for independent purchase of commercial house shall not be paid cash directly as amount of monetary resettlement; 2) The subsidy for independent purchase of commercial house will be given to persons with house requisitioned, with an amount of RMB 50,000 per suite. 3) As for commercial houses for independent purchase by persons with house requisitioned, the municipal housing bureau shall provide the relevant house resource information, and publish on the relevant information platform. D. Policy of Security Resettlement of Dwelling House: 1) If the family per capita building area of person with house 77 requisitioned is lower than per capita building area standard of Harbin City in previous year, the gross building area of house of such person is lower than 40m2, and such person is unable to afford the funds in full amount for purchase of part of area of house in standard type (with an area of 50m2) exceeding the building area of original house, the security type house with a building area of 40m2 may be selected for property right exchange; as for part of area of security type house exceeding the building area of original house, the person with house requisition may pay the funds for purchase of such part according to construction and installation cost, or rent temporarily such security type house according to cost rent, and later make a supplementary payment of purchase funds after improvement of his economic conditions; 2) The residents holding Urban Resident’s Minimum Living Security Certificate will receive a subsidy with an amount of RMB 20,000; the disabled holding Certificate of the Disabled of the People’s Republic of China will receive a subsidy with an amount of RMB 10,000. E. Policy of Resettlement of Non-dwelling House (Changed from Dwelling house): As for non-dwelling house, the following three methods may be selected for resettlement. These three resettlement methods include monetary resettlement, property right exchange in area specified by government, independent purchase of commercial houses, etc. As for requisition of non-dwelling rental house belonging to public property under direct administration of operating unit, in case that the leasing relationship between the operating unit of such public property with authorization of the government and tenant can not be terminated, the house property right exchange may be implemented for such house, and the original leasing relationship is maintained continuously. In case of requisition of non-dwelling rental house of the unit, the property owner and tenant shall make negotiation in advance. In case of termination of leasing relationship after negotiation, the compensation shall be made for the property unit according to laws; in case of failure of termination of leasing relationship after negotiation, the house property right exchange shall be implemented, and the original leasing relationship is maintained continuously. If the property unit has transferred the house property right to the tenant, the house ownership holder shall be compensated according to laws after implementation of transfer of rights between both parties and acquisition of house ownership by the original tenant. 1) In case of selecting monetary resettlement, the value of house requisitioned shall be evaluated and determined by the real estate price evaluation agency with corresponding qualification, and the compensation shall be made on the basis of deserved amount of monetary resettlement plus 30% of such amount. 2) In case of selecting property right exchange of dwelling house, the building area of 10m2 may increased additionally according to standard of property right exchange of dwelling house; such increased area shall be purchased according to comprehensive construction cost or standard of property right exchange of dwelling house, and the difference in evaluated value shall be settled. 78 3) In case of independent purchase of commercial house, the compensations can be received on the basis of monetary resettlement amount plus 30% of such amount, and the monetary funds for independent purchase of commercial house received by persons with house requisitioned through monetary resettlement shall be calculated according to market value of ordinary commercial house with same location and type in the requisition project after deduction of amount for purchase of house in standard type with area larger than that of original house; the person with house requisition shall purchase independently the commercial house and settle the difference in evaluated value. F. Preferential Policy of Property Right Exchange in Area Specified by Government 1) Within specified deadline of signing a contract, the beneficial building area less than 10m2 according to house in standard type with building area larger than that of original house may enjoy the comprehensive construction cost as per building area of 10m2; after enjoying the beneficial building area, the area up to area of house in standard type with building area larger than that of original house shall be purchased according to preferential price of commercial house. 2) If the person with house requisitioned has selected the dwelling house in the Taoci Resettlement Quarter with high-rise commercial house under construction, such person can purchase a building area of 20m2 according to preferential price of commercial house, which is RMB 5,300/m2, on the basis of area of house in standard type with area larger than that of original house requisitioned; in case of purchasing more area out of 20m2, such area shall be purchased according to a price of RMB 6,300/m2 for building area. 3) If the person with house requisitioned has selected the dwelling house in the Wutongjun Resettlement Quarter with high-rise commercial house, such person can purchase a building area of 20m2 according to preferential price of commercial house, which is RMB 4,300/m2, on the basis of area of house in standard type with area larger than that of original house requisitioned; in case of purchasing more area out of 20m2, such area shall be purchased according to a price of RMB 5,000/m2 for building area. 4) If the person with house requisitioned has selected the dwelling house in the Dongsheng Jiangjun Resettlement Quarter with high-rise commercial house, such person can purchase a building area of 20m2 according to preferential price of commercial house, which is RMB 5,500/m2, on the basis of area of house in standard type with area larger than that of original house requisitioned; in case of purchasing more area out of 20m2, such area shall be purchased according to a price of RMB 6,500/m2 for building area. G. Policy of Compensation for Tenant 1) As for dwelling house belonging to public property, the tenant of such house shall himself handle the formalities of property right change; after completion of formalities of property right change, the person with house requisitioned shall carryout the compensation resettlement 79 to the house tenant according to standard for house ownership holder. The operating unit of public property under direct administration with authorization of the government shall carry out the consultation with tenant of non-dwelling house; in case of termination of leasing contract and selection of monetary resettlement, the compensation shall be made for operating unit of public property under direct administration and house tenant respectively as per proportions of 15% and 85% of compensation amount for house requisitioned. 2) As for dwelling house belonging to private property, the property owner shall carry out the consultation with the tenant of house property; in case that the prediction of house requisition has been made in the lease agreement signed by the property owner with the tenant, and the corresponding handling method has been specified, the compensation may be implemented according to the handling method specified in the lease agreement. In case of non-existence of relevant agreement, the property owner shall return the rent and cash deposit to the tenant, and make compensation for losses in decorations, relocation, operation, etc. due to house requisition to the tenant, and the compensation amount shall be determined according to consultation of the parties. VI. Organization and Implementation Plan The Owner of the Project is Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company. The implementing agency of resettlement and demolition is the House Requisition Office of the People’s Government of Daowai District, and the coordinating agency of overall works is Leading Group Office of Promoting Works of Key Railway Project Construction of Harbin City. Harbin-Jiamusi Railway Passenger Dedicated Line Limited Liability Company, Urban House Demolition Management Office of the People’s Government of Daowai District of Harbin and Leading Group Office of Promoting Works of Key Railway Project Construction of Harbin City jointly govern the construction and land acquisition/demolition of Harbin-Jiamusi Railway and Harbin-Mudanjiang Railway. However, the Harbin-Jiamusi Railway is the project with foreign capital loan, the management requirement and procedures are also different to some extent with Harbin-Mudanjiang Railway, so the responsible persons from the land acquisition and demolition departments of these organizations are especially and independently organized to be responsible for management of land acquisition and demolition of Harbin-Jiamusi Railway, and the members are the responsible persons of various communities involved in demolition, and especially cooperating with and supporting the railway construction and implementation of resettlement. VII. Project Information Disclosure and Grievance Mechanism At early stage of project preparation, the propaganda and information release have been carried out, in order to guarantee the degree of understanding of the Project. By way of such various media as broadcasting, television, newspaper, magazine, etc., the followings of the Project shall be widely propagated: purpose and meaning of project construction, time and location of project construction, as well as detailed stipulations for implementation of national policies of land acquisition and demolition established by provincial, municipal and district governments at all levels. Prior to implementation of demolition, the proclamation of unified land acquisition and demolition shall be published to all persons impacted. The purpose is make the persons impacted understand the 80 related issues about unified land acquisition and demolition, scope of land acquisition and demolition, policies o compensation and resettlement and other relevant stipulations. During implementation of resettlement, in order to guarantee the benefits of persons impacted, the resettlement office will build up a set of highly transparent simple procedures of collecting and handling discontents and complaints, so as to objectively, equitably and efficiently handle discontents and complaints of the PAPs, thereby ensuring the smooth progress of resettlement. The grievance mainly is divided into the following three stages: Stage 1: The persons impacted may propose their complaints to the Demolition Office of Daowai District in form of oral compliant or written compliant. The Demolition Office of Daowai District must keep the written records of oral complaints and reply clearly within two (2) weeks. VIII. In case of monetary resettlement by ready house and independent purchase of commercial house, the compensations for temporary resettlement shall be paid one-off for six (6) months. In case of property right exchange, as for person with requisitioned house carrying out temporary resettlement 1) House himself, the compensations for temporary resettlement shall be calculated monthly within transition period and issued once every six (6) Urban displacement, months; in case of exceeding 24 months, the compensations for temporary resettlement with a standard of RMB 40/m2 as per building area of residential compensations original house shall be issued monthly since the overdue date. In case of compensations for temporary resettlement less than RMB 500, the housing 2) Relocation fees; compensations shall be paid as per RMB 500 monthly. 3) Transition fees Standard of subsidy for indoor self-decorations of house demolished: the compensation amount shall be determined through consultation between Remover and person with house demolished; in case of failure of consultation, such compensations shall be determined by the entrusted evaluation agency according to document FLF [2009] No.01. Incentive standard for demolition: on the basis of one household holding one property right certificate or leasing certificate, every household will be provided with incentive fees for house-moving with an amount of RMB 12,000, when the persons with house requisitioned have carried out the house-moving themselves and passed through acceptance within specified deadline of signing a contract. The household, Urban which has carried out the house-moving and demolition in advance himself within specified deadline, will be given with incentive subsidies a demolition subsidy standard of RMB 200/m2 as per building area of original house. Compensation fees for relocation of non-dwelling house (incl. those changed from dwelling houses): The relocation fees for access of cable TV, telephone line and Internet shall be calculated as per standard specified by the corresponding department at the time of requisition; the compensation fees for relocation, disassembly and assembly of machines, materials as well as facilities and equipment for gas, dynamic electricity and production water supply shall be calculated according to actual conditions or a standard of RMB 30/m2 of original house. The residual value of equipment unable to return to service shall be calculated as per replacement price and depreciation rate. Compensations for temporary resettlement of non-dwelling house (incl. those changed from dwelling houses): the compensation standard is RMB 35/m2 per month according to building area of original house, and the compensations shall be calculated from the date of 1) House acceptance of actual removal from original house. In case of monetary resettlement, the compensations for temporary resettlement shall be displacement, Non-dwelling paid one-off for six (6) months. In case of property right exchange, as for person with requisitioned house carrying out temporary resettlement compensations house himself, the compensations for temporary resettlement shall be calculated monthly within transition period and issued once every six (6) 2) Relocation fees; months; in case of exceeding 24 months, the compensations for temporary resettlement with a standard of RMB 70/m 2 as per building area of 3) Transition fees original house shall be issued monthly since the overdue date. Compensation for loss of stop of production and close of business of non-dwelling house (incl. those changed from dwelling houses): as for stop of production and close of business caused due to house requisition, in case of obtaining business license, handling tax registration by laws and being able to provide tax certificate issued by competent tax authorities prior to publication of announcement on house requisition, the compensation for loss shall be paid to persons with requisitioned house either for six (6) months in case of monetary resettlement, or by the month during transition period in case of property right exchange, according to average monthly taxable income, number of staff and workers determined by the labor service insurance department to which the labor insurance consolidated fund is paid, as well as average wage 82 of staff and workers of Harbin City in previous year.
