It is based on a supervision mission conducted in Mauritania from 25 to 29th April 2016 and in Togo from 8 to 12 June 2015. MAURITANIA: Significant progress was made since the October 2015 supervision mission. Progress was made on the bid evaluation process regarding the construction contract or the missing fiber optic links of the national backbone which is now expected to end in September 2016; and the signature of this contract is expected by end of October 2016. Although they are not all met yet, progress has also been made on the three remaining disbursement conditions related to the PPP for the national backbone: (i) The Mauritanian Government has signed the Main Contractual Agreement with the SDIN on January, 25, 2016 (legal opinion on this agreement is expected by august 15, 2016); (ii) the International Mauritania Telecom (IMT, the entity operating the ACE cable and designated to operate the national backbone assets) has obtained the necessary authorization as required for the operation of the national backbone assets (the alignment between the authorization and its cahier des charges still needs to be finalized) from the Regulatory Authority on May 19, 2015; and (iii) Agreement on the key provisions of the delegation contract between SDIN and IMT has been met and recorded in the negotiation minutes dated September 7, 2014. With respect to the legal covenant pertaining to the revision not later than September 30, 2013 of existing ICT legal and regulatory framework, the new electronic communications law was promulgated on July 31, 2013. With respect to the 4 Information Society draft Laws, two were approved by the parliament on December 22, 2015; the two other Information Society Laws are expected to be approved by September 2016. The procurement process for activities No. 433 (Establishment of a national data center) and No. 435 (Establishment of an electronic certification office) of the 2012-2016 Strategy for ICT and Modernization of Public Service have registered good progress and are still underway. Furthermore, the Internet Exchange Point was created and inaugurated on November 27th, 2015. A peering agreement was signed on june 27, 2016 and domestic traffic is going through the IXP, which is now fully operational. Finally the EIB co-financing agreement signed on October 23, 2013 was made effective June 5, 2014. All supervision missions are conducted jointly with EIB; bidding documents for the backbone links as well as safeguard documents were reviewed and cleared by both institutions. The Government and the World Bank will work closely to accelerate (i) the signature of the construction contract for the missing fiber optic links of the national backbone; (ii) progress in the setting up of the Public Private Partnership; and (iii) approval by the Council of Ministers and Parliament of the four Information Society Laws. With 17.39% disbursement rate at the end of July 2016, disbursements are behind forecast due to delays in launching the bidding process for the national backbone. There are 18 disbursement conditions (5 for the WB and 13 for the EIB). As of July 2016, 2 of the 5 WB conditions and 10 of the 13 EIB conditions have been met. A follow-up mission in Mauritania is planned in October/November 2016 to monitor progress on the disbursement conditions and on the construction process of the missing fiber optic links of the national backbone as well as to prepare the upcoming mid-term review. The Project Development Objective Indicators and the Intermediate Results Indicators have been updated with the data as of July 28, 2016. TOGO: The Project implementation has encountered delays at the beginning due to fiduciary difficulties, as two major studies planned in the Project (« Feasibility study and implementation support to set up the carrier hotel » and « Setting up PPP framework for SPV and support for bandwidth purchase ») started with significant delays (respectively in March 2015 and May 2015). Nevertheless, these studies should be completed by end of Q1 2017, which will open to way to the construction of the carrier hotel financed by the Project, provided that legal covenants of the Project are complied with, namely (i) the establishment of a Carrier Hotel and the Internet Exchange Point to be operated with due diligence and efficiency and to be managed in a manner suitable to ensure services are delivered according to Open Access principles and (ii) the conclusion of a contractual agreement (“Main Contractual Agreement”) with the SPV to finance the Carrier Hotel and Internet Exchange Point. Lifting these conditions will require a significant amount of efforts, which implies the need for a very strong commitment of all parties involved in the next six months.
